Highway Widening. [ * ] has attached hereto as EXHIBIT J true, correct and complete copies of all correspondence and materials that reflect the status of the negotiations in all material respects (including all drawings of proposed plans) that [ * ] has in its possession and more particularly described on the attached Schedule 3.
7.1.1 hereto regarding a highway widening contemplated by the Government of the [ * ], Public Works Department (the "PWD") for [ * ] Road (now known as [ * ] Road) being a portion of [ * ]. To the best of [ * ]'s knowledge, (i) the PWD remains open to the submission of a formal plan of development by [ * ] or its successor and (ii) the land the PWD is contemplating taking or condemning is more particularly shown on the plan attached hereto as part of EXHIBIT J.
Highway Widening. The Owner shall convey, in fee simple and free from encumbrances, any lands which may be required by the City, Region and/or MOT, for the purpose of road widenings and for the purpose of establishing a one (1) foot (0.3 metre) reserve across that portion of the frontage of real properties herein not required for an entrance or exit, in order to ensure proper ingress to and egress from the Lands as set out in Schedule “C” and in accordance with the Final Site Plans to the satisfaction of the Director of Planning. All specialized parking spaces (such as barrier free accessible parking, parent with young child parking, etc.) shall be identified with appropriate signage and surface paintings (with durable traffic paint) to the satisfaction of the Director in his or her sole discretion in accordance with the City’s requirements. The performance standards for barrier free parking and bike parking are set out in the Urban Design Manual and shall be provided by the Owner on the Lands in accordance with the Final Site Plans and drawings for the life of the Development.
