The City Manager may change the holidays on Christmas Eve and New Year's Eve to the working day immediately preceding or following the working day on which Christmas Day and/or New Year's Day will be celebrated. 16.6 2. Presidential Election Day, Good Friday and Yom Kippur are floating holidays.
3. An annual holiday schedule will be made available to all Employees at the beginning of each calendar year.
4. An Employee called must be either at work or on paid leave on the workdays before and after a holiday to be paid for that holiday. An Employee who calls in sick before or immediately following an Agency observed holiday on which the Employee is scheduled to be off may be required to submit a doctor’s note in order to receive holiday pay.
5. Full-time Employees will accrue one (1) day of holiday leave for an Agency observed holiday that falls on a regularly scheduled day off. Full-time Employees required to work on a holiday, or who has their shift extended on a holiday, shall holiday will be paid for each hour actually the day worked at 2 times the Employee’s base pay rate if and accrue one (1) day of holiday leave.
6. Part-time Employees may use or accrue holiday leave only for those Agency observed holidays that fall on a day on which they were not are regularly scheduled to work. Part-time Employees who work during that time. Should an employee have used more holiday leave at the time of separation or leaving the bargaining unit than they would be entitled in lieu accordance with the above formulas, the employer will subtract from the employee’s annual leave bank the number of holidays.
16.2 Requests days used in excess of those earned. Employees separated from county service or leaving the bargaining unit shall be paid for their unused accumulation of Holiday Leave at the salary rate the employee is being paid on his or her last day of actual work in the bargaining unit. This payment shall be at the employees straight time rate. Scheduling and use of holiday leave time shall be made subject to the following restrictions:
(1) Holiday leave shall be used and scheduled in writing by the Employee and in accordance with the leave section of this Article. The Employer reserves the sole right to grant same manner as annual leave.
(2) Employees may not accumulate holiday leave time.
16.3 Holiday leave time shall not accumulate from one year to the next year. Up to 88 hours of holiday leave time that is remaining in the Employee's holiday leave bank on December 31 shall be cashed-out at the Employee's current base pay rate. Any hours greater than 88 remaining in the Employee's holiday leave bank on December 31 shall be forfeited.
16.4 Holiday leave time for a new Employee, an Employee leaving employment, or a part-time Employee shall be appropriately prorated to reflect the actual holidays observed by the Employer as of the date of the event affecting employment status. If an Employee leaving employment has taken more holiday leave time than the appropriate pro-rated amount, the difference shall be deducted from the Employee's final paycheck.
16.5 An Employee scheduled to work on Independence Day, Thanksgiving Day, Christmas Eve Day and Christmas Day will be paid 2 times the base rate of pay for every hour worked. An Employee scheduled to work any hours on the remaining holidays designated by this contract shall be paid 1½ times base rate of pay for every hour worked on that holiday. 16.6 An Employee called in to work on a holiday, or who has their shift extended on a holiday, Employees shall be paid for each hour actually worked any unused holiday leave for the period December 1 to November 30 on the first payday following the end of the pay period which includes November 30. Payment for unused holiday leave shall be at 2 times the Employeeemployee’s base straight time rate of pay rate if they were not scheduled to work during that time. If the Employee is called in to work, or has their shift extended on a double time holiday, the Employee shall earn 2 ½ times the Employee’s base pay rate if they were not scheduled to work during that timeNovember 30.
16.7 An Employee scheduled for training during any hours of (3) The one floating holiday which all employees have enjoyed in the past will not be subject to the above holidays shall regulations, but will continue to be paid for each hour governed by the provisions of actual training at one and one half (1 ½ ) times the Employee’s base pay rateMerit Rule 26.1.2.
16.8 An Employee working a shift all or in part on Independence Day, Thanksgiving Day, Christmas Eve, or Christmas Day shall be paid at two (2) times the Employee’s base pay rate for their scheduled shift, if four or more hours of the shift occur on the holiday. Double time payment under this paragraph shall be limited to the greater of 10 hours or actual hours worked.
16.9 If relevant Minnesota statute, currently Minn. Stat. § 645.44, Subd. 5, is amended during the duration of this agreement to include Juneteenth, June 19; holiday leave hours as referenced in paragraphs 16.1 and 16.3 of this agreement shall be increased by 8 hours to reflect such holiday if applicable in the calendar year, and paragraph 16.5 of this agreement shall be amended to include Juneteenth if applicable in the calendar year.

Holiday Leave. 16.1 Each Employee Holiday leave is provided by the City to allow employees the opportunity to celebrate recognized holidays. An employee celebrating a City-recognized holiday will not be permitted to use any City-provided leave time other than holiday leave. Except as otherwise provided for in this Agreement, each employee shall use holiday leave on City- recognized holidays. Holiday leave shall be credited with 96 hours earned as holidays occur, shall be used in the fiscal year it is earned, and shall not be carried over to the following fiscal year. Employees shall receive the following days of paid holiday leave time in a holiday leave bank, on January 1 of each year in lieu of holidays.

16.6 An Employee called in (10 hours earned) New Year's Eve Day (10/4 hours earned—one-half of the department heads will receive the full day off [those who received 4 hours off on Christmas Eve Day], the other half of the department heads will receive 4 hours off, as determined by the City Manager) In the event any of these holidays fall on a Sunday, the following Monday shall be considered as the holiday. If a scheduled holiday should fall on a Friday or Saturday, the preceding Thursday shall be considered as the holiday, or applicable hours shall be credited to employees' holiday banks. The City Manager may change the holidays on Christmas Eve and New Year's Eve to the working day immediately preceding or following the working day on which Christmas Day and/or New Year's Day will be celebrated. In the event that the City returns to a 5-day, 40-hour workweek, Lincoln's Birthday, Columbus Day, and Friday After Thanksgiving will be reinstated as 8-hour holidays; Christmas Eve and New Year's Eve will be converted back to 4-hour holidays; and all other recognized holidays will be converted back to 8-hour holidays. If, for reasons of protecting the public safety or welfare, or upon approval of the City Manager, an employee is required to work on a City-recognized holiday, or who has their shift extended on a earned holiday hours shall be credited to the employee's holiday accrual bank. Hours credited to the holiday accrual bank shall be equal to the actual time worked by the employee, but not greater than the maximum number of hours earned for the holiday, . Employees leaving City service with accrued holiday leave shall be paid the amount of accrued holiday hours to the date of termination. Payments for each hour actually worked at 2 times the Employee’s base pay rate if they were not scheduled to work during that time. If the Employee is called in to work, or has their shift extended on a double accrued holiday time holiday, the Employee shall earn 2 ½ times the Employee’s base pay rate if they were not scheduled to work during that time.
16.7 An Employee scheduled for training during any hours of the above holidays shall be paid for each hour at the employee's current hourly rate of actual training at one and one half (1 ½ ) times the Employee’s base pay ratepay.
16.8 An Employee working a shift all or in part on Independence Day, Thanksgiving Day, Christmas Eve, or Christmas Day shall be paid at two (2) times the Employee’s base pay rate for their scheduled shift, if four or more hours of the shift occur on the holiday.
