Terminal Pay. Any employee at normal retirement or his/her beneficiary if service is terminated by death, shall be provided terminal pay. Such terminal pay shall not exceed an amount determined as follows: 1. During the first three (3) years of service: a. The affected employee’s daily rate of pay on July 1, 1994, multiplied by 35 percent multiplied by the number of unused sick leave days held on July 1, 1994. b. The affected employee’s daily rate of pay at the time sick leave is earned times 35 percent times the number of days of accumulated sick leave earned after July 1, 1994. 2. During the fourth (4th) through sixth (6th) years of service: a. The affected employee’s daily rate of pay on July 1, 1994, multiplied by 40 percent multiplied by the number of unused sick leave days held on July 1, 1994. b. The affected employee’s daily rate of pay at the time sick leave is earned times 40 percent times the number of days of accumulated sick leave earned after July 1, 1994. 3. During the seventh (7th) through ninth (9th) years of service: a. The affected employee’s daily rate of pay on July 1, 1994, multiplied by 45 percent multiplied by the number of unused sick leave days held on July 1, 1994. b. The affected employee’s daily rate of pay at the time sick leave is earned times 45 percent times the number of days of accumulated sick leave earned after July 1, 1994. 4. During the tenth (10th) through the twelfth (12th) year of service: a. The affected employee’s daily rate of pay on July 1, 1994, multiplied by 50 percent multiplied by the number of unused sick leave days held on July 1, 1994. b. The affected employee’s daily rate of pay at the time sick leave is earned times 50 percent times the number of days of accumulated sick leave earned after July 1, 1994. 5. During and after the thirteenth (13th) year of service: a. The affected employee’s daily rate of pay on July 1, 1994, multiplied by the number of unused sick leave days held on July 1, 1994. b. The affected employee’s daily rate of pay at the time sick leave is earned* multiplied by the number of days of accumulated sick leave earned. 6. No employee who meets the eligibility requirements listed above may receive any compensation for sick leave payments unless they sign and execute the Payment of Sick Leave Upon Retirement Agreement provided by the Superintendent. Terminal Pay. A. To encourage and reward full-time permanent employees who exercise particular care in the maintenance of their personal health and job attendance, the Board will provide terminal pay to employees at normal retirement, resignation, or to their beneficiaries, if services are terminated by death. Any employee not in service at the time of retirement shall not receive these benefits. Terminal pay shall not exceed an amount determined by the daily rate of the employee at retirement, resignation, or death, as follows: 1. During the first three years of service, the daily rate of pay multiplied by 35% times the number of days of accumulated sick leave; 2. During the next three years of service, the daily rate of pay multiplied by 40% times the number of days of accumulated sick leave; 3. During the next three years of service, the daily rate of pay multiplied by 45% times the number of days of accumulated sick leave; 4. In no case, however, shall an employee whose daily rate has been frozen pursuant to this provision receive less than the amount determined as in D. below. B. Provisions for terminal pay at resignation apply only to those sick leave days accrued after July 1, 1982. C. Payment for the resignation and retirement benefit will be made in the fiscal year subsequent to the one in which the employee resigns or retires. D. Resignation or retirement, as referred to herein, shall mean termination of employment by action of the employee; such termination excludes resignation or retirement after a recommendation for dismissal or resignation or retirement after participation in a work stoppage, job action, or strike, in the absence of specific approval by the Board. E. The daily rate shall be computed by dividing the number of "working days" that year into the annual salary. "Normal retirement," as referred to herein, shall mean retirement under any retirement system established by the Legislature with either full or reduced benefits as provided by law. Terminal Pay. Upon the death of a member, payment for all accumulated sick leave, vacation accrual, holiday accrual, compensatory time and all other terminal pay shall be made to the designated beneficiary in a lump sum. If there is no designated beneficiary, said payment shall be paid to the surviving spouse. If there is no surviving spouse, the said death benefit shall be paid to the estate of the deceased member. This payment shall be made no greater than thirty (30) days after proof of death of a member.

Accumulated sick leave shall include only the number of days for which the employee earned sick leave days with the School Board of Saint Lucie County. Years of service shall only include service with the School Board. 3. Terminal pay, when paid upon retirement or termination, shall be paid only if the employee is retiring or terminating under favorable circumstances, not if the employee is being dismissed by the Board. Only employees in service or on approved leave at the time of retirement shall receive these benefits.

Terminal Pay. A. A terminal leave payment for unused, accumulated paid leave days will be paid upon retirement, provided the teacher shall have been employed in the school district for fifteen (15) years. The payment shall be calculated using the accumulated paid leave days (with a maximum of 170) multiplied by $50/day. Such payment shall be paid within forty-five (45) calendar days of the last date of service. Days compensated in this manner may not be donated to the sick leave bank. B. In order to qualify for the above payment, an otherwise eligible retiring teacher shall notify the Superintendent by April 15 for a retirement effective at the end of the school year. Such notification shall be made by November 1 for a retirement effective at the end of the calendar year. C. The terms "employed in the school district" whenever used in this Article shall mean employment as either a member of the bargaining unit as defined in the Recognition clause (Article I, ¶ A) of this Agreement or time employed in any professional administrative capacity for the Hastings Area School System. All other periods of non-bargaining unit service to the Hastings Area School System shall not be regarded or considered by the parties as time "employed in the school district" for purposes of eligibility for terminal leave retirement incentive, or other separation payments under this Article. D. A "year" of employment for purposes of this Article shall be fulfilled by teaching or administrative service of at least 93 days in a school fiscal year (July 1 - June 30). For purposes of this provision, "teaching or administrative service" shall be inclusive of periods of paid leave. Bargaining unit members who are "employed in the school district" (as defined in ¶ E of this Article) for less than 93 days in a given school year, may aggregate partial years of bargaining unit and/or administrative service with the Board for purposes of meeting the years of service requirements under this Article.
