Host to Not Restrict Solar Access. Host , or any lessee, grantee or licensee of Host "Host" means [Host], a [_____] [corporation], and all successors and assigns., shall not erect any structures on, or make other modifications to, or plantings on, the Site which will interfere with the construction, operation or maintenance of, or solar access of, the Project . [(13b) The customer will not alter the host site such that it interferes with the Tioga solar electric system.
Host to Not Restrict Solar Access. The Host, or any lessee, grantee or licensee of the Host, shall not erect any structures on, or make other modifications to, or plantings on, any Premises or near any Premises which will interfere with the construction, operation or maintenance or solar access of the Projects (except as required to maintain the safety and operational functions of the Premises or as otherwise required by Applicable Law or by direction from a Governmental Authority). To the extent that any such actions cause a reduction of electrical production, in addition to the amounts the Host will pay hereunder for electric energy produced by and delivered from a Project, the Host will also pay the Contractor, an amount equal to the sum of (i) payments that the Host would have made to the Contractor hereunder for the amount by which electric energy that would have been produced by the Project has been reduced by such actions, (ii) revenues that Contractor would have received with respect to the Project under any Applicable Solar Program and any other assistance program with respect to the amount by which the electric energy that would have been produced has been reduced by such actions, and (iii) the value of Tax Attributes that Contractor would have received with respect to the amount by which such Tax Attributes from the Project have been reduced by such actions. The Host and Contractor shall cooperate in good faith to address any solar access interference by any third party in an attempt to eliminate or mitigate such interference. Notwithstanding the foregoing, nothing in this Section 14(b) shall limit or restrict the Host’s ability to act in its governmental capacity.

  • Certification Regarding Prohibition of Boycotting Israel (Tex Gov. Code 2271) If (a) Vendor is not a sole proprietorship; (b) Vendor has ten (10) or more full-time employees; and (c) this Agreement or any agreement with a TIPS Member under this procurement has value of $100,000 or more, the following certification shall apply; otherwise, this certification is not required.   • Parent Right to Access and Challenge Student Data The LEA shall establish reasonable procedures pursuant to which a parent, as that term is defined in 105 ILCS 10/2(g), may inspect and/or copy Student Data and/or challenge the accuracy, relevance or propriety of Student Data, pursuant to Sections 5 and 7 of ISSRA (105 ILCS 10/5; 105 ILCS 10/7) and Section 33 of SOPPA (105 ILCS 85/33). The Provider shall respond to any request by the LEA for Student Data in the possession of the Provider when Provider cooperation is required to afford a parent an opportunity to inspect and/or copy the Student Data, no later than 5 business days from the date of the request. In the event that a parent contacts the Provider directly to inspect and/or copy Student Data, the Provider shall refer the parent to the LEA, which shall follow the necessary and proper procedures regarding the requested Student Data.
