Common use of Hours Between Shifts Clause in Contracts

Hours Between Shifts. a. Any regular work performed with less than ten (10) hours off is to be compensated at the overtime rate. However, in instances where an employee voluntarily waives the ten-hour period, the employee shall not be compensated at the overtime rate. b. Whenever practicable, flexible scheduling shall be allowed in connection with unit retraining, subject to the approval of management. Approval shall not be unreasonably withheld or withheld for an arbitrary, capricious or discriminatory reason.
