Common use of Immediate Suspension Clause in Contracts

Immediate Suspension. Nothing herein shall preclude the District from effectuating an immediate suspension with or without pay with subsequent action pursuant to Section 5, Notification and Hearing of this Article when reasonable cause exists to believe that the unit member’s presence at work could prove to be harmful or injurious to the District. Prior to effecting an immediate suspension by the Superintendent, or designee, the unit member shall be given notice of such proposed suspension, the reason for proposed suspension, and the opportunity to respond. This notice and the opportunity to respond shall be in writing. Such suspension shall be with pay if the dismissal is subsequently overruled. Any unit member charged with the commission of any sex offense as defined in Education Code, Section 44010 or any narcotics offense as defined in Section 44011 of the Education Code by complaint, information or indictment filed in a court of competent jurisdiction, may be suspended as provided for in Section 45304 of the Education Code.

Prior 18 to effecting affecting an immediate suspension by the Superintendent, Superintendent or designeethe Director of Human Resources, the 19 unit member shall be given notice of such proposed suspension, the reason for proposed suspension, 20 and the opportunity to respond. This notice and the opportunity to respond shall be in writing.
