Common use of IN SERVICES Clause in Contracts

IN SERVICES. (a) The Employer reserves the right to identify specific in-service sessions as being compulsory for Employees and those required to attend such sessions shall be paid at the applicable rate of pay for attendance. The cost of materials and tuition for an in-service session offered by the Employer shall be paid for by the Employer for those Employees whose attendance is compulsory. In addition to any in-service the Employer may identify as compulsory, the following in-service programs shall be compulsory and shall be provided to Employees on an annual basis: (i) Cardio-Pulmonary Resuscitation; (ii) Anaphylaxis; (iii) Fire (hands on experience with equipment except where not required by the Employer’s established written fire procedures); (iv) Evacuation and disaster procedures; and (v) Proper lifting and prevention of back injuries. (b) Employees who attend in-service programs which are not identified as compulsory by the Employer shall suffer no loss of regular earnings for attending such programs. (c) The Employer shall provide in-service education to ensure that each Employee has the opportunity to attend not less than 23 hours per year. The 23 hours shall be in addition to any hours necessary for the compulsory in- service as provided for in Article 35.02(a) and shall include a yearly in-service for the purpose of explaining the pension plan to Employees, as well as an in- service on prevention and management of staff abuse.
