Income Representations. Associates must always present the Talk Fusion income opportunity in a fair and honest fashion. Associates must not overstate the income potential, must never represent that successor income is assured to those who join as Talk Fusion Independent Associates.

Income Representations. Projections of income earnings representations are strictly prohibited. Personal Stylists may, however, disclose to potential recruits their actual earnings, prizes or results from the preceding year only, but only if all three of the following requirements are satisfied: (1) they have documentation available to verify their income claims; (2) they provide a copy of the latest Independent Personal Stylist Compensation Summary in conjunction with any income representation; and (3) they fully and accurately disclose their business expenses incurred in achieving the income, prize or result. In addition, except as expressly authorized in official X.Xxxxxxx materials, Personal Stylists must make the following disclaimer in conjunction with any earnings claims: THERE ARE NO GUARANTEES REGARDING INCOME, AND THE SUCCESS OR FAILURE OF EACH INDEPENDENT PERSONAL STYLIST, LIKE ANY OTHER BUSINESS, DEPENDS ON EACH INDEPENDENT PERSONAL STYLIST’S SKILLS AND EFFORT. THE RESULTS OBTAINED BY ANY INDIVIDUAL INDEPENDENT PERSONAL STYLIST ARE ANECDOTAL ONLY, AND MAY BE ATYPICAL. “Lifestyle” claims (e.g., “My X.Xxxxxxx business has allowed my spouse to be a full-time homemaker; my X.Xxxxxxx commissions have allowed me to fulfill my dreams; my income from X.Xxxxxxx exceeded the income from my previous job in only months”), which are considered to be equivalent to income claims. Accordingly, the Income Disclaimer referenced above and a copy of X.Xxxxxxx’x Independent Personal Stylist Compensation Summary (Career Plan) should be provided to prospective recruits whenever a Personal Stylist utilizes “Lifestyle” claims in promoting their X.Xxxxxxx business. Income and/or lifestyle claims may only be included on video and/or audio materials if the materials begin and end with the Income Disclaimer listed above. In addition, such materials must also include a full recitation of the Independent Personal Stylist Compensation Summary. Any video close-up shot of the Income Disclosure Statement or Income Disclaimer should be shown long enough to allow a viewer to easily read the entire content.

The Buyer understands and acknowledges that the Brokerage must be impartial when representing both the Buyer and the seller and equally protect the interests of the Buyer and the seller in the transaction. The Buyer understands and acknowledges that when representing both the Buyer and the seller, the Brokerage shall have a duty of full disclosure to both the Buyer and the seller, including a requirement to disclose all factual information about the property known to the Brokerage. However, The Buyer further understands and acknowledges that the Brokerage shall not disclose: • that the seller may or will accept less than the listed price, unless otherwise instructed in writing by the seller; • that the Buyer may or will pay more than the offered price, unless otherwise instructed in writing by the Buyer; • the motivation of or personal information about the Buyer or seller, unless otherwise instructed in writing by the party to which the information applies or unless failure to disclose would constitute fraudulent, unlawful or unethical practice; • the price the Buyer should offer or the price the seller should accept; and • the Brokerage shall not disclose to the Buyer the terms of any other offer. However, it is understood that factual market information about comparable properties and information known to the Brokerage concerning potential uses for the property will be disclosed to both Buyer and seller to assist them to come to their own conclusions. Where a Brokerage represents both the Seller and the Buyer (multiple representation), the Brokerage shall not be entitled or authorized to be agent for either the Buyer or the Seller for the purpose of giving and receiving notices.
