Independent Action on Lands Protected by Another Agency. All fire suppression actions conducted on lands of other Agencies shall be consistent with the Jurisdictional Agency’s land management policy. Any participating agency may, upon its own initiative, at the risk of their own expense, and with appropriate notification and coordination, respond to wildland fires on lands that are under the direct protection of another agency. Parties to this Operating Plan shall not perform any fire suppression action that is contrary to limitations.

Independent Action on Lands Protected by Another Agency. Except as otherwise described in Annual Operating Plans, nothing herein shall prohibit any Agency, on its own initiative and without reimbursement, from going upon lands known to be protected by another Agency to engage in suppression of wildfires, when such fires are a threat to lands within that Agency's protection responsibility. In such instances, the Agency taking action will promptly notify the Protecting Agency. Actions taken will be consistent with the Protecting Agency's suppression policies. These Protecting Agencies’ actions will be commensurate with the jurisdictional agencies land management considerations, and be subject to the laws and regulations of the jurisdictional agency. The agency taking independent action will assume financial responsibility for those actions.
