Common use of Indigenous Peoples Clause in Contracts

Indigenous Peoples. The Borrower shall cause each Qualified Enterprise to ensure that Qualified Projects do not adversely affect vulnerable groups, such as indigenous peoples, and in the event of any impact or their involvement, the Borrower shall cause each Qualified Enterprise to implement the social safeguards framework as set out in the ESSF in accordance with its terms to ensure compliance with ADB’s Policy on Indigenous Peoples (1998).

Indigenous Peoples. The Borrower shall ensure that IDCOL shall cause each Qualified Enterprise to ensure that Qualified Projects do not adversely affect vulnerable groups, such as indigenous peoples, and in the event of any impact or their involvementimpact, the Borrower IDCOL shall cause each Qualified Enterprise to implement the social safeguards framework as set out in the ESSF in accordance with its terms so as to ensure compliance with ADB’s Policy on Indigenous Peoples (1998).

Pursuant to the relevant paragraph of the ESSF, the Borrower shall provide to ADB an annual Safeguards Monitoring Report concerning any impacts on Indigenous Peoples (1998)indigenous peoples.
