OBLIGATIONS OF THE GOVERNMENT. (1) The Government may at the request of the Contractor, make available to the Contractor such land as the Contractor may reasonably require for the conduct of Petroleum Operations and - (a) Where the land is Trust Land, the Government may, subject to sub- clause 17(2) set apart such Trust Land in the Contract Area or outside the Contract Area in accordance with the Trust Land Act; (b) Where the land is private land, the Government may, subject to section 10 of the Act, acquire the land in accordance with the applicable laws; (c) The Contractor shall pay or reimburse the Government any reasonable compensation that may be required for the setting apart, use or acquisition of any land for the Petroleum Operations as settled by an Expert Determination. (2) Where the Contractor has occupied Trust Land for the purpose of the Petroleum Operations before that land has been set apart, the Contractor shall notify the Minister in writing of the need to set apart such land. (3) The Government shall grant or cause to be granted to the Contractor, its contractors and sub-contractors such way-leaves, easements, temporary occupation or other permissions within and without the Contract Area as are necessary to conduct the Petroleum Operations and in particular for the purpose of laying, operating and maintaining pipelines and cables, and passage between the Contract Area and the Delivery Point of petroleum. (4) The Government shall at all times give the Contractor the right of ingress to and egress from the Contract Area and the facilities wherever located for the conduct of Petroleum Operations. (5) Subject to the usual national security requirements and the Immigration Act and Regulations of Kenya in particular, the Government shall not unreasonably refuse to issue and/or renew entry visas or work permits for employees, technicians and managers employed in the Petroleum Operations by the Contractor or its sub-contractors and their dependants. OBLIGATIONS OF THE GOVERNMENT. 1. In order to implement this Agreement the Government shall: a) Make available to the Commission the respective site(s) with or without infrastructure, equipment, logistic support, personnel and/or experts, as agreed in the respective Implementing Protocol; b) Agree that the activities carried out as part of Projects under this Agreement shall be carried out pursuant to the decisions, regulations, rules and draft operational manuals of the Commission; c) Exercise reasonable care to ensure safety and security of the participants on the premises of the site(s) and, if necessary, provide a briefing to participants on such matters; d) Grant access to the premises of the site(s) to the PTS Team for the duration of the Project activity; and e) Facilitate the temporary import and the re-export of the equipment and material required for the Project activity in accordance with the relevant laws and regulations. 2. In addition, the designated authority for the Government shall: a) Facilitate in-country transportation of the PTS Team, equipment and other property related to the Project; b) Facilitate accommodation of the PTS Team; c) Provide necessary equipment for presentations, if any, including paper, photocopiers, fax machines, audiovisual units and staff as applicable; d) Provide administrative support during the Project activities as required; e) Provide medical support for first aid within the area for field activities, and in the case of serious emergencies, ensure immediate transportation and admission to hospital; and f) Assist in organizing the expedited return of PTS Team members in the event of emergency.

OBLIGATIONS OF THE GOVERNMENT. 6.1.1 The Government shall, at its own cost and expense undertake, comply with and perform all its obligations set out in this Agreement or arising hereunder. 6.1.2 The Government agrees to provide support to the Concessionaire and undertakes to observe, comply with and perform, subject to and in accordance with the provisions of this Agreement and the Applicable Laws, the following: (a) upon written request from the Concessionaire, and subject to the Concessionaire complying with Applicable Laws, provide reasonable support and assistance to the Concessionaire in procuring Applicable Permits required from any Government Instrumentality for implementation and operation of the Project; (b) upon written request from the Concessionaire, provide reasonable assistance to the Concessionaire in obtaining access to all necessary infrastructure facilities and utilities, including water and electricity at rates and on terms no less favourable to the Concessionaire than those generally available to commercial customers receiving substantially equivalent services; (c) procure that no barriers are erected or placed on or about the Project Highway by any Government Instrumentality or persons claiming through or under it, except for reasons of Emergency, national security or law and order or collection of inter-state taxes; (d) make best endeavours to procure that no local Tax, toll or charge is levied or imposed on the use of whole or any part of the Project Highway; (e) subject to and in accordance with the Applicable Laws, grant to the Concessionaire the authority to regulate traffic on the Project Highway; (f) assist the Concessionaire in procuring police assistance for regulation of traffic, removal of trespassers and security on or at the Project Highway; (g) not do or omit to do any act, deed or thing which may in any manner be violative of any of the provisions of this Agreement; and (h) support, cooperate with and facilitate the Concessionaire in the and operation of the Project in accordance with the provisions of this Agreement.
OBLIGATIONS OF THE GOVERNMENT. AND THE NON-FEDERAL SPONSORS, paragraph A, subparagraph 7, is amended by replacing “$30,000,000” in the first sentence with “$60,000,000”.
OBLIGATIONS OF THE GOVERNMENT a. To ensure that the Contractor has the Government’s full cooperation in the exercise of the rights granted to it under this Agreement; b. To use its best efforts to ensure the timely issuance of necessary permits and similar authorizing documents for use of the surface of the Contract Area; and c. To cooperate with the Contractor in its efforts to obtain financing contemplated herein from banks or other financial institutions: Provided, That such financing arrangements will in no event reduce the Contractor’s obligation on Government rights hereunder.
OBLIGATIONS OF THE GOVERNMENT. 6.1.1 The Government shall, at its own cost and expense undertake, comply with, and perform all its obligations set out in this Agreement or arising hereunder: 6.1.2 The Government agrees to provide assistance and support to the Beneficiary Firm on the following, subject to and in accordance with the provisions of this Agreement and Applicable Laws: (a) upon written request from the Beneficiary Firm, and subject to the Beneficiary Firm complying with Applicable Laws, provide reasonable support and assistance in procuring the Applicable Permits required from any Government Instrumentality for setting up and operation of the Project; (b) upon written request from the Beneficiary Firm, provide reasonable support and assistance to the Beneficiary Firm in obtaining access to all necessary infrastructure facilities and utilities; and (c) support, cooperate with and facilitate the Beneficiary Firm in the implementation and operation of the Project in accordance with the provisions of this Agreement and Applicable Laws. 6.1.3 The Government agrees to disburse Subsidy, as specified in Schedule – B, to the Beneficiary Firm, in accordance with Clause 11.2. 6.1.4 The Government shall authorize representatives to inspect the certificates provided by the Beneficiary Firm validating the Value Addition and Committed Capacity.

OBLIGATIONS OF THE GOVERNMENT. (a) Subject to the availability of funds, and subject to the provisions contained in this Agreement, the Government agrees to perform at its sole expense the Relocation described in Exhibit “A”, at the place shown on the drawing(s) and in the manner prescribed by the Plans and Specifications, approved by the Owner prior to the commencement of the Relocation. (b) Government shall make such necessary surveys and prepare such drawings, schedules, and specifications in connection with the Relocation as may be required. (c) Government shall furnish, subject to the conditions hereinafter stipulated, all services, labor, materials, tools, equipment, permits and licenses necessary and essential to the reconstruction, Relocation, rearrangement, and/or alteration of the aforesaid facilities. The Relocation shall be constructed through standard Government procedures. (d) Any drawings, maps, and specifications which may be furnished by the Government shall be subject to written approval by the Owner or its authorized representative before any work to which they relate is performed. (e) Government shall issue amendment to existing easement substantially in the form attached hereto as Exhibit “X” to Owner upon completion of alteration of Owner’s Facility.
OBLIGATIONS OF THE GOVERNMENT. 1. The Government shall provide, in accordance with national laws and within the limits of budgetary appropriations: (a) The personnel referred to in Article II, paragraph 1,(b) and (d); (b) Furnished and equipped premises a nd maintenance thereof necessary for the fulfilment of the Institute's purposes; (c) Facilities for the printing of publications of the Institute; (d) Facilities in institutions for training, research and demonstration purposes. The institutions used by the Institute and its staff shall not be considered as forming administratively part of the Institute; (e) Such equipment, technical literature and other reference material as may be required by the programme and research of the Institute; (f) Anyothe r contribution which may be necessary for the successful implementation of the programme of the Institute, including transport facilities; (g) Medical and hospital assistance to the staff internationally recruited by the Organization. 2. The Government shall make the Institute available to eligible United Nations fellowship holders or other persons from the region, and for this purpose shall facilitate in accordance with national laws and regulations their entry into Japan and their sojourn there. 1. Officials and experts of the Organization appointed to serve on the Institute shall be accorded privileges and immunities provided under Articles V, VI and VII of the Convention on the Privilieges and Immunities of the United Nations. 2. Those Articles of the Convention on the Privileges and Immunities of the United Nations which are referred to in the preceding paragraph are reproduced in the Annex to this Agreement.
