Common use of Indigenous Peoples Clause in Contracts

Indigenous Peoples. The Borrower shall ensure that the Project will not negatively impact vulnerable groups, such as indigenous peoples. In the unforeseen event that indigenous people are affected by the Project, the Borrower shall ensure that the Project complies with ADB’s Policy on Indigenous Peoples (1998) and all applicable laws and regulations of the Borrower.

Indigenous Peoples. The Borrower shall ensure that the Project will does not negatively impact vulnerable groups, such as have any adverse impacts on the indigenous peoples, within the meaning of ADB’s Safeguard Policy Statement (2009). In the unforeseen event that indigenous people are affected by the ProjectProject does have such impact, the Borrower shall take all steps required to ensure that the Project complies with ADB’s Policy on Indigenous Peoples (1998) and all the applicable laws and regulations of the BorrowerBorrower and with ADB’s Safeguard Policy Statement.

In the unforeseen event that indigenous people are affected by the Project, the Borrower and the Project Executing Agencies shall ensure that the Project complies with ADB’s Policy on Indigenous Peoples (1998) and all applicable laws and regulations of the Borrower.
