Injured on Duty. 43.01 An employee who is injured on the job or suffers a recurrence of an injury on the job shall, as soon as possible, report the matter to the Supervisor or Department Head and file a Workers' Compensation claim. (a) An employee who is injured on the job or suffers a recurrence of an injury on the job and who has his Workers' Compensation claim approved shall receive benefits pursuant to the Workers' Compensation Act. (b) Employees who are receiving compensation benefits under the Workers' Compensation Act shall earn vacation and sick leave credits in accordance with Articles 26 and 27. However, vacation leave credits may only be earned up to one leave year as per Article 26.01. 43.03 The absence of an employee who is injured on the job or suffers a recurrence of an injury on the job and who is waiting for approval of a Workers' Compensation claim, and/or who is receiving benefits under the Workers' Compensation Act shall not be charged against the employee's sick leave credits, vacation credits, or any other accumulated credits except as provided in 43.04. 43.04 Notwithstanding Article 43.03, an employee, who as a result of having suffered an injury on the job is without revenue while waiting to receive compensation benefits pursuant to the Workers' Compensation Act, may apply for a monetary advance from the Employer subject to the following conditions: (a) that he has requested such advance at least three (3) days before each of his regular pay days; (b) that he agrees to assign compensation payments equal to the same amount and same period of time; (c) that the employee has the necessary vacation and/or sick leave credits; or is eligible for a sick leave advance under 27.14. (d) payment shall commence following a three (3) day waiting period stipulated under the (e) the advance shall be equivalent to the compensation payable pursuant to the Workers' Compensation Act, for the same period, until such time as the claim is approved or denied; (f) if the claim is not approved, the employee shall be entitled retroactively to use any accumulated sick leave credits in accordance with Article 27; (g) the Employer will credit any sick leave days used for this purpose to the employee's accumulated sick leave upon receipt of the assigned compensation payments following approval of the claim; (h) for the purpose of calculating the monetary advance, one full accrued sick leave credit shall be used for each of the employee's scheduled working days; and (i) upon approval of the Worker's Compensation claim, the employee will be credited with seniority for the required waiting period stipulated under the Workers' Compensation Act.

If an employee has not accumulated seventy two (72) hours of sick leave, and if his disability ends in less than fourteen (14) calendar days, he shall be paid sick leave credits in accordance with Article 27;during the first (1st) week of disability; however, the payment for that week shall be charged against his future accrual of sick leave. (gC) If any employee covered by this Agreement shall be entitled to receive benefits or payments from the Employer will credit any sick leave days used Police and Fireman’s Disability and Pension Fund or the Public Employee’s Retirement System, the foregoing provisions of this article shall not be effective. (D) Section (A) and (B) above shall not be effective unless the injury is of such severity as to require medical care, and a request for I.O.D. pay shall be made in writing on a form provided by the Safety Service Director, unless an employee is physically unable to do so, and the employee shall also sign a medical release form for records pertaining to this purpose specific injury only. (E) The employee shall be required to provide a physician’s statement verifying the employee's accumulated sick leave upon receipt ’s injury. He shall further be required to furnish a physician’s statement verifying he is capable of returning to normal or light duty. (F) Each employee shall be entitled to a one thousand two hundred forty-eight (1,248) hours per injury on duty. If an employee returns to full duty, the balance of the assigned compensation payments following approval one thousand two hundred forty-eight (1,248) hours related to that specific injury shall be held in reserve for future aggravation or reoccurrence of the claim;that injury. (hG) for the purpose of calculating the monetary advanceThe Safety Service Director may, one full accrued sick leave credit shall be used for each of from time to time, require a medical report from the employee's scheduled working days; and’s attending physician verifying the disability. Injured on Duty. 43.01 30.01 An employee who is injured prevented from performing her regular work with the Employer on the job or suffers a recurrence account of an injury on occupational accident that is covered by the job Workers’ Compensation Act shall be paid by the Workers’ Compensation Board. 30.02 Notwithstanding Article 30.01, in the event that the salary of an employee, at the time of a claim under the Workers’ Compensation Act, exceeds the maximum annual earnings established by regulation, the Employer shall, during the period the employee is in receipt of temporary earnings loss benefits, continue to pay the employee an amount equal to 80% (85% after 39 weeks) of net income on a bi-weekly basis on that portion of salary which is in excess of the maximum earnings recognized by the Workers’ Compensation Board. In the event the employee receives compensation from the Worker's Compensation Board for the waiting period, the employee shall be entitled retroactively to use any accumulated repay the Employer for the sick leave credits in accordance with Article 27; (g) utilized during the Employer will credit waiting period and any sick leave days used for this purpose granted will be re-credited to the employee's accumulated sick leave upon receipt of the assigned compensation payments following approval of the claim; (h) for the purpose of calculating the monetary advance, one full accrued sick leave credit shall be used for each of the employee's scheduled working days; and (i) upon approval of the Worker's Compensation claim, the employee will be credited with seniority for the required waiting period stipulated under the Workers' Compensation Actbank.
