Common use of Injury Clause in Contracts

Injury. 2.1 The provisions of the Accident Insurance Act 1998 or any amendment or Act passed in substitution for this Act shall apply. 2.2 Where the absence from work as a result of an injury (work or non-work or motor vehicle) accident the employee must provide copies of the claim for cover and expenses, initial medical certificate and any further medical certificates. 2.3 Employees must report any work accident and any resulting injury to their manager, and complete the necessary documentation as soon as possible after the event. 2.4 Employees requiring treatment as a result of an accident or emergency during a period of duty shall be entitled to free emergency treatment provided by the employer through a nominated registered medical practitioner or other health care provider as approved by the employer. 2.5 Where absence from work is due to injury arising from a work related injury or motor vehicle accident the employer shall: a) Make up the balance of pay between full ordinary pay and the 80% of earnings-related- compensation covered by the employer’s workers compensation insurer. The duration of the makeup payment will be subject to active compliance with Hutt Valley DHB’s rehabilitation programme that has been mutually agreed between the parties. b) Make up any difference between the amount accepted by the employer’s workers compensation insurer and the fee paid by the employee for treatment in relation to the accident where that course of treatment has been approved by Hutt Valley DHB. 2.6 Where absence from work is due to injury arising from a non-work related injury the employer shall make up the balance of pay between full ordinary pay and the 80% of earnings-related-compensation covered by the employer’s workers compensation insurer. The duration of the makeup payment will be subject to active compliance with Hutt Valley DHB’s rehabilitation programme as mutually agreed between the parties, and will be for a maximum of 3 months.
