INSPECTION, ACCEPTANCE OR REJECTION OF GOODS. All goods shipped pursuant to this order shall be received subject to Buyer's inspection on Buyer's premises, within a reasonable time after delivery and Buyer's normal warehousing period. Any payment of invoice shall not constitute acceptance of goods covered by this order and shall be without prejudice to any and all claims of Buyer against Seller. Buyer may reject as nonconforming all goods not in accordance with this order, including but not limited to failure to comply with items 3 through 6 of these Terms and Conditions. Goods, products and supplies ordered hereunder shall be subject to inspection by Xxxxx or government inspectors upon the premises of Seller. Any acceptance of goods or services received pursuant to this order expressly made or implied from Xxxxx's conduct is conditioned upon Seller's cure of any nonconformity, whether or not such nonconformity substantially impairs the value of such goods or services.

INSPECTION, ACCEPTANCE OR REJECTION OF GOODS. All Goods are subject to final inspection and acceptance by NCTD at the delivery location unless otherwise specified. NCTD will inspect the Goods and either accept or reject them within a reasonable time. If any specified inspection or testing is required to determine if the Goods meets the specifications, Contractor shall perform or shall have performed such inspections and tests at Contractor’s sole cost prior to the delivery to NCTD. Any Goods received damaged, or not in accordance with the instructions or specifications on the PO, will be rejected and returned to Contractor at Contractor’s risk and expense. NCTD will notify Contractor in writing stating the reason(s) why the Goods are deemed damaged or nonconforming. Contractor will have ten (10) business days or, if mutually agreed upon in advance, an agreed upon date to deliver conforming Goods. NCTD will hold the damaged or non- conforming Goods for a reasonable time not to exceed thirty (30) calendar days and Contractor must remove the rejected Goods at Contractor’s sole cost and expense.

Contractor will have 10 business days or an otherwise agreed upon date to deliver conforming goods. MTS will hold the damaged or non-conforming goods for a reasonable time not to exceed 30 calendar days and Contractor must remove the rejected goods at Contractor’s sole cost and expense.
INSPECTION, ACCEPTANCE OR REJECTION OF GOODS. Items purchased hereunder will be inspected at time of delivery at project destination. In addition to its other rights and remedies, Buyer reserves the right to reject and refuse acceptance of items which are not in accordance with the instructions, specifications, drawings, and data or Vendor’s warranty. Payment for any item shall not be deemed an acceptance thereof.
