Institutional Lender. Institutional Lender" means a state or federally chartered savings bank, savings and loan association, credit union, commercial bank or trust company, or foreign banking institution authorized to do business in New York (whether acting individually or in a fiduciary capacity); an insurance company organized and existing under the laws of the United States or any state thereof or a foreign insurance company authorized to do business in New York; a publicly held real estate investment trust; a brokerage or investment banking organization (acting as principal or agent); a religious, educational or eleemosynary institution; an employees’ welfare, benefit, pension or retirement fund; any governmental agency or entity insured by a governmental agency or any combination of Institutional Lenders; provided that each of the above entities shall qualify as an Institutional Lender only if it shall: (i) be subject to the jurisdiction of the courts of the State of New York in any action; and (ii) have assets of not less than One Hundred Million Dollars ($100,000,000.00) adjusted for inflation.
Institutional Lender. The term "Institutional Lender" -------------------- as used in this Section 4 shall refer to a savings bank, savings and loan association, commercial bank, trust company, credit union, insurance company, college, university, real estate investment trust or pension fund. The term "Institutional Lender" shall also include other lenders of substance which have assets in excess of Fifty Million and No/100 Dollars ($50,000,000.00) at the time the Leasehold Mortgage is made.

For purposes of this Article 14, “Institutional Lender” shall mean a state or federally chartered savings bank, savings and loan association, credit union, commercial bank or trust company or a foreign banking institution (in each case whether acting individually or in a fiduciary or representative (such as an agency) capacity); a pension fund, an insurance company organized and existing under the laws of the United States or any state thereof or a foreign insurance company (in each case whether acting individually or in a fiduciary or representative (such as an agency) capacity); a publicly held real estate investment trust, an entity that qualifies as a “REMIC” under the Internal Revenue Code or other public or private investment entity (in each case whether acting as principal or agent) which at the date hereof or in the future is involved in the business of investing in real estate assets; a brokerage or investment banking organization (in each case whether acting individually or in a fiduciary or representative (such as an agency) capacity); an employees’ welfare, benefit, pension or retirement fund; an institutional leasing company; any governmental agency or entity insured by a governmental agency, or any combination of Institutional Lenders.
Institutional Lender. The Transaction Documents and the agreements contemplated thereby have been approved by Accelerant's lender.
Institutional Lender. An "INSTITUTIONAL LENDER" shall mean: (1) a bank (state, federal or foreign), trust company (in its individual or trust capacity), insurance company, credit union, savings bank (state or federal), pension, welfare or retirement fund or system, real estate investment trust, a nationally recognized investment bank, a finance subsidiary of a Fortune 500 company (such as AT&T Capital Corporation or General Electric Capital Corporation), real estate mortgage investment conduit, or securitization trust; (2) any issuer of collateralized mortgage obligations or any similar investment entity (provided that such issuer or other entity is publicly traded or was or is sponsored by an entity that otherwise constitutes an Institutional Lender or has a trustee that is, or is an Affiliate of, any entity that otherwise constitutes an Institutional Lender); (3) any Person that is a wholly owned subsidiary of or is a combination of any one or more of the foregoing Persons; or (4) any of the foregoing when acting as trustee for other lender(s) or investor(s), whether or not such other lender(s) or investor(s) are themselves Institutional Lenders.

Institutional Lender. Any of the following Persons that is not a Prohibited Transferee: (a) a Federal or State regulated bank; (b) trust company (in its individual or trust capacity); (c) insurance company; (d) credit union; (e) savings bank (State or Federal); (f) pension, welfare, or retirement fund or system; (g) real estate investment trust (or an umbrella partnership or other entity of which a real estate investment trust is the majority owner); (h) Federal or State agency regularly making or guaranteeing mortgage loans; (i) a Federal or State regulated investment bank; (j) a Fortune 500 company; (k) a wholly-owned subsidiary of a Fortune 500 company (such as AT&T Capital Corporation or General Electric Capital Corporation); or (l) any Person that is an Affiliate of or is a combination of any one or more of the Persons described in clauses “(a)” through “(k)” of this Section 2.60.

Institutional Lender. Such mortgage shall be held by an institutional lender, namely a bank, savings and loan association, credit union, insurance company, pension fund, annuity fund, or government agency engaged in the business of making commercial first mortgage loans.
