The Data shared under this Addendum will be used solely for the purpose of implementing the ERP Solution under the direction of the OFM/One Washington Program, according to approved project parameters. The Data may not be used for any other purpose. INTENDED USE OF DATA. Under Penal Code section 1172 and subsections, the Merced County DA is working with a qualified community-based organization, For The People (FTP) to aid in the review and analysis of data for resentencing where appropriate. California Civil Code, Section 1798.24(o), Information Practices Act of 1977, allows CDCR to disclose data to another requesting law enforcement or regulatory agency. Penal Code section 1172.1 authorizes the district attorney of the county in which the defendant was sentenced to, on its own motion, request the sentence and commitment previously imposed on an inmate be recalled and that the court resentence the inmate provided the new sentence is no greater than the initial sentence. The Merced County DA will use the information to review which offender falls under Penal Code section 1172.1 for recall and resentencing. Merced County DA is required to fingerprint and have background check clearance on all county staff as well as FTP staff that will have access to data elements requested in this agreement. It is the Merced County DA responsibility to ensure proper protocols are in place related to background check clearance and those who have access to the data requested throughout the term of this agreement.
