ISM and ISPS Code. With effect from the Delivery Date of its Vessel, each of the Borrowers will comply with and continue to comply with and procure that the Manager complies with and continues to comply with the ISM Code, the ISPS Code and all other statutory and other requirements relative to its business and in particular each Borrower or the Manager will obtain and maintain a valid DOC and SMC for each Mortgaged Vessels and that it and the Manager will implement and continue to implement an ISM SMS;
ISM and ISPS Code the Borrower will comply with and continue to comply with and procure that the Technical Manager complies with and continues to comply with the ISM Code, the ISPS Code and all other statutory and other requirements relative to its business and in particular the Borrower or the Technical Manager will obtain and maintain a valid DOC and SMC for the Vessel and that it and the Technical Manager will implement and continue to implement an ISM SMS;
ISM and ISPS Code the Borrower and the Owners have complied with and continue to comply with and have procured that the Managers of the Ships have complied with and continue to comply with the ISM Code, the ISPS Code and all other statutory and other requirements relative to their business and in particular they or the Managers have obtained and maintains a valid DOC and SMC for the Ships and that they and the Managers have implemented and continue to implement an ISM SMS;
ISM and ISPS Code. It will arrange for and procure the punctual approval and certification of the management organisation on shore and on board the Vessels and ensure that the Vessels are operated in accordance with the ISM-Code and ISPS-Code in force from time to time and will promptly notify the Agent of any breach thereof.
ISM and ISPS Code. Each Guarantor has complied with and continues to comply with and has procured that the Approved Manager has complied with and continues to comply with the ISM Code, the ISPS Code and all other statutory and other requirements relative to its business and in particular the Guarantors or the Approved Manager have obtained and maintain a valid DOC and SMC for the Vessels and that each Guarantor and the Approved Manager has implemented and continues to implement an ISM SMS;
ISM and ISPS Code the Administrative Agent shall have received a copy of the DOC, SMC, ISSC and IAPPC with respect to each of the Collateral Vessels;
ISM and ISPS Code the Administrative Agent shall have received a copy of the DOC, SMC, ISSC and IAPPC for the Vessel to which such Delivery Advance relates;
ISM and ISPS Code. Copies of:
(a) the document of compliance issued in accordance with the ISM Code to the person who is the operator of the Ship for the purposes of that code;
(b) the safety management certificate in respect of the Ship issued in accordance with the ISM Code to be delivered within five (5) days after the Utilization Date;
(c) the international ship security certificate in respect of the Ship issued under the ISPS Code to be delivered within five (5) days after the Utilization Date; and
(d) if so requested by the Administrative Agent, any other certificates issued under any applicable code required to be observed by the Ship or in relation to its operation under any applicable law.
ISM and ISPS Code the Borrower is conducting their business and operations in compliance with the ISM Code and the ISPS Code;
ISM and ISPS Code each Borrower has complied with and continues to comply with and has procured that any Manager of the Vessel owned by that Borrower has complied with and continues to comply with the ISM Code, the ISPS Code and all other statutory and other requirements relative to their business and in particular it or any Manager has obtained and maintains a valid DOC, IAPP Certificate, EIAPP Certificate (if applicable) and SMC for the Vessel owned by that Borrower and all other certificates required for the operation of such Vessel and that it and any Manager of such Vessel has implemented and continues to implement an ISM SMS;
