Common use of January Public Holiday Clause in Contracts

January Public Holiday. a) Unless you are a casual employee, you and the Company may agree to substitute another day for a day that would otherwise be the Australia Day (“26 January”) public holiday under the NES if the 26 January public holiday is a day you would ordinarily work. b) Time worked on the 26 January public holiday and time taken off on the elected substitute day will be paid based on Fixed Remuneration plus any grandfathered and/or higher duties allowance (if applicable). c) If you are required by the Company to work on your elected substitute day, you may be eligible for additional payments as set out in clauses 19.2, 20, 63, 68.3 and 69.2, but you will not be eligible for such payments for working on the 26 January public holiday to the extent these clauses confer entitlements for working on a public holiday. d) All other terms and conditions of employment provided under this Agreement that are usually observed for public holidays will apply to the elected substitute day, and not the 26 January public holiday.
