Federal Holidays. The Employee shall be entitled to federal holidays per calendar year. This is subject to change by the Employer from time to time. If for any reason the Employee should request a Federal Holiday off, the Employer shall determine if the Employee may do so and if it shall be taken from either the Employee’s Personal Leave or Vacation Time. Federal Holidays are determined by the Employer and may change every calendar year.
Federal Holidays a. In accordance with 5 USC Section 6103(a), the following are legal public holidays recognized by DeCA: New Years Day, January 1 Birthday of ▇▇▇▇▇▇ ▇▇▇▇▇▇ ▇▇▇▇, ▇▇. the third Monday in January ▇▇▇▇▇▇ ▇▇▇▇▇▇▇▇▇▇’▇ Birthday, the third Monday in February Memorial Day, the last Monday in May Independence Day, July 4 Labor Day, the first Monday in September Columbus Day, the second Monday in October Veterans Day, November 11 Thanksgiving Day, the fourth Thursday in November Christmas Day, December 25 Additional holidays declared by the Congress or the President will also be recognized.
b. For full-time employees whose basic schedule is Monday through Friday, when the legal, public holiday falls on a Saturday, the Friday preceding it is the day treated as the holiday. If the holiday falls on Sunday, the following Monday is the day treated as the holiday.
c. In accordance with 5 USC 6103(b), the following rules apply:
(1) Part-Time employees who are scheduled to work on a legal public holiday will be paid for that holiday.
(2) Part-Time employees who are not scheduled to work on a legal public holiday will not be entitled to holiday pay.
d. For Part-Time employees prevented from working due to in-lieu-of holiday, the
(1) administrative leave, if approved by the EMPLOYER on a holiday-by- holiday basis;
(2) annual leave, accrued compensatory time, leave without pay, or time off award;
(3) reschedule hours within the same pay period to recapture hours otherwise lost; or
(4) a combination of the above.
Federal Holidays. A. If a holiday falls on a regular workday, that day is the employee’s holiday. If a holiday falls on any non-workday other than Sunday, the day of the “in lieu of” holiday is the preceding workday; e.g., if a holiday falls on Monday and if Monday is a non-workday for the employee under their flexible 5/4/9 or 4/40 work arrangement, the “in lieu of” holiday is the previous Friday. If a holiday falls on Sunday the next workday is the “in lieu of” holiday; e.g., if a holiday falls on Sunday and if Monday is a non-workday for the employee under their flexible 5/4/9 or 4/40 work arrangement, the “in lieu of” is Tuesday.
B. Holidays that fall on an employee’s 9 hour day require the employee to use one hour of leave or an earned credit hour to account for the holiday period. To avoid charge to leave or an earned credit hour the employee will be permitted to either move their 8 hour day to the holiday or charge their day off to the holiday.
C. Holidays that fall on an employee’s 10 hour day require the employee to use two hours of leave or two hours of earned credit hours to account for the holiday period.

(b) In addition to the annual holidays, the Government may observe additional days as holidays to include: • Any other day designated by Federal Statue • Any other day designated by Executive Order • Any other day designated by the President’s Proclamation
(c) Unless otherwise authorized by the Contracting Officer, observance of holidays by Government personnel shall not otherwise be a reason for an extension to the period of performance, delivery schedule, or entitlement of payment by the Government to the Contractor. In the event the Contractor’s personnel (including subcontractors) work during the holiday, they may be compensated for the work in accordance with the Contractor’s operational/employee/business procedures; however, no form of holiday or other premium compensation will be paid by the Government, either as an additional direct or indirect cost, over the payments authorized in the IDIQ contract or task orders.
(d) When the Government grants excused absence to its employees (e.g., office closing due to inclement weather), onsite Contractor personnel may be dismissed by the Contractor at its discretion. However, such a dismissal will not be an excuse to change any service or delivery requirements under the IDIQ contract or task orders. For awarded Time and Materials (Labor Hour) task orders, the Contractor is cautioned that only those hours actually worked may be billed to the Government. The Contractor agrees to continue to provide sufficient personnel to perform critical tasks already in operation or scheduled, unless otherwise authorized by the Contracting Officer.
(e) Extension of a task order period of performance or delivery schedule will not be provided for Federal holidays in paragraph (a) or (b) above. However for task orders, if necessary, and with approval of the COR, extension of the period of performance or delivery schedule may be granted by the Contracting Officer on a case-by-case basis for closings described in paragraph (d) above.
Federal Holidays. No work shall be performed on Embassy holidays. Exhibit C provides a listing of scheduled American Embassy holidays & Local Holidays.
Federal Holidays. Federal holidays as published by the Office of Personnel Management are granted to Federal employees. In addition to the days designated as Federal holidays, the Government may also observe any day designated by Federal Statute, Executive Order, or President’s Proclamation. Notwithstanding holidays and Government closures, the Contractor shall perform in accordance with the terms established in the Master Contract and associated task orders. The Contractor shall refer to the awarded task order for guidance on access to facilities and requirements for performance on the days that Federal holidays are observed, and to ensure compliance with Services Contract Labor Standards and the ▇▇▇▇▇ ▇▇▇▇▇ Act requirements, if applicable.

3.1 Contractor personnel performing at a Government site shall observe federal holidays and other days identified in this section unless otherwise indicated in an order.
