JOB FAIR. The job fair process shall be the primary method for filling teacher vacancies requiring specific RIDE certifications provided the following conditions are followed: 1. Whenever possible, the Job Fair shall be held prior to the end of school. A second Job Fair may be held later if needed. An electronic copy of the anticipated vacancies shall be provided to each member no later than one week prior to the Job Fair. 2. Job Fair is one day and will be held annually. 3. Should a teacher be unable to attend the Job Fair, but wishes to bid on a position, he may provide for a proxy. To provide for a proxy, the teacher must complete a proxy form authorizing a single designee to act as the teacher's proxy and submit the form to the Superintendent. 4. Teachers maintaining a certification and Highly Qualified status, where applicable, in the subject area of a vacant position shall be presumed to be appropriately qualified for the position and shall be appointed consistent with provisions contained within this Article; provided, however, this presumption may be rebutted where: a. The teacher has received an “Ineffective” rating with his most recent evaluation, or; b. the teacher is on an improvement/assistance plan, or; c. the teacher is non-tenured. The Superintendent, in his sole discretion, may waive the limitations in a, b, and c. 5. Part-time employees seeking additional employment and non-tenured displaced teachers shall not be prohibited from transferring to vacant positions provided appointments are made consistent with provisions contained within this Article. 6. Seniority, certification, and eligibility for participation (see #4 above) must be verified prior to the Job Fair (included shall be those people who will be certified as of June). An updated hard/or electronic copy of the seniority list shall be provided to each member one week prior to the Job Fair. 7. All vacant positions (as defined below, except as limited by Article 9.B.2) shall be posted and made available at the Job Fair. a) Vacant Positions are those positions newly created by the Committee after the previous Job Fair, and those positions resulting from any of the following events: i) Retirement ii) Resignation iii) Discharge iv) Promotion v) Death vi) Successful Transfer (including in the Job Fair), vii) When temporary positions become permanent, or, viii) When a part-time position is increased in FTE status. 8. Vacancies shall be filled in the following order: a. A teacher who has been non-renewed, and who can be recalled to his position of record after completing the budget process, shall have his non-renewal rescinded prior to Job Fair. b. Displaced teachers shall be recalled to the position from which they were displaced should it become available. A newly available position may be held open and not placed on the Job Fair list if a displaced teacher has rights to said position. c. Job Fair shall be held for all eligible teachers (as defined in this article) interested in transferring to these vacancies. d. All selections by teachers shall be honored based upon seniority, appropriate certification, and qualifications defined in Article 10.A.4. e. No selection shall be allowed under this procedure if the final effect causes the blocking of the recall of a teacher on the recall list, unless i. the blocking is caused by a permanent teacher selecting a position which blocks the recall of a teacher hired for a temporary position ii. the blocking results in a senior teacher on recall being recalled to a position. g. After the job fair, teachers on the recall list shall then be recalled in accordance with the provisions of Article 9. 9. Positions remaining vacant at the end of the day of the Job Fair are not open to transfer. 10. Teachers on leave may participate in Job Fair and members on lay off or recall may attend the Job Fair. Any position remaining vacant at the conclusion of Job Fair will first be filled by recall and then posted according to Article 10.B. 11. JOB FAIR. Between the end of the school year and June 30 (or within one week of the end of school, whichever occurs later, unless changed by agreement of the parties), the parties will convene a Job Fair for: teachers who may be interested in a possible transfer, teachers who have been notified of an involuntary transfer, teachers returning from a leave of absence of one year or more, except as provided in 9-2.2 (Sabbatical) and 9-12.6 (Job Sharing) and/or those teachers who have no permanent assignment.
(A) The job fair process parties agree that each year, the President of the Union and the Director of Human Resources shall meet annually on or before May 1st to discuss and agree to the date, rules, and procedure for the Job Fair.
(B) Teachers who wish to transfer to another position in the bargaining unit in September shall submit a request in writing to attend the Job Fair. The written request will be made to the Director of Human Resources by June 15 unless the date is changed by agreement of the parties.
(C) A letter of acknowledgement shall be forwarded to the primary method for filling teacher vacancies requiring specific RIDE certifications provided upon receipt of the following conditions are followed:request to attend the Job Fair.

a(G) Vacant Positions are Placement of involuntarily transferred teachers, teachers with no assignments (those who were hired for positions newly created by the Committee which became available after the previous year‟s Job Fair and therefore must bid on a permanent assignment at the next Job Fair), and teachers returning from a leave of absence, may necessitate restricted bidding in some subject areas at the Job Fair. If bidding is restricted, only those teachers who currently hold a teaching assignment in the area of the restricted bidding are eligible to bid on the vacant position.
(H) When a vacancy is to be filled at the Job Fair, and those positions resulting from any the successful bidder will be the teacher with the greatest seniority who holds the requisite teaching certificate. Exceptions are: situations involving restricted bidding or the allowance of an involuntarily transferred teacher to return to their department/school if a vacancy becomes available through the following events:
i) Retirement
ii) Resignation
iii) Discharge
iv) Promotion
v) Death
vi) Successful Transfer (including in the Job Fair),
vii) When temporary positions become permanentbidding process. In cases where a common seniority date prevails, or,
viii) When a part-time position is increased in FTE status.
8. Vacancies shall be filled in the following order:

Certified teachers hired for a temporary position (e.g. one year only), shall that teacher successfully renewing his/her certification before his/her new assignment begins at the start of the school year. The Warwick Public Schools will not be allowed to select a position until all teachers with permanent positions are allowed to make a selection.
f. No selection shall be allowed under this procedure if the final effect causes the blocking responsible for providing copies of the recall of a teacher certificates on the recall list, unless
i. the blocking is caused by a permanent teacher selecting a position which blocks the recall of a teacher hired for a temporary position
ii. the blocking results in a senior teacher on recall being recalled to a position.
g. After the job fair, teachers on the recall list shall then be recalled in accordance with the provisions of Article 9.
9. Positions remaining vacant at the end of the day of the Job Fair are not open Fair. If a teacher fails to transferproduce the requisite valid certificate at that time, the position will then be awarded to the teacher with the next greatest seniority who produces a valid teaching certificate for the position.
10. Teachers (J) As teachers successfully bid on leave may participate vacant positions at the Job Fair, the positions from which they are transferring shall be available for bidding and filled in Job Fair the same manner.
(K) All known vacancies and members on lay off or recall may attend newly created vacancies are to be posted for bidding at the Job Fair. Any position remaining vacant Said vacancies shall not be filled permanently with newly hired teachers unless no other member of the bargaining unit has chosen to bid on said vacancies at the conclusion of Job Fair.
(L) If a position is vacated after the Job Fair, and if the position is not one which can be filled by a suspended (laid off) teacher, the vacancy shall be filled by a permanent teacher on a temporary basis until the next Job Fair unless the vacancy has been posted system-wide. A newly created position which occurs after the Job Fair shall likewise be filled on a temporary basis.
(M) Teachers arriving late at the Job Fair will first be filled by recall and then posted according given the opportunity to Article 10.B.bid on any subsequent positions offered for bid after their arrival. However, no later bids will be accepted for positions offered for bid prior to arrival.
11(N) Each teacher who has been awarded a position at the Job Fair shall receive written verification which memorializes in writing his/her new teaching assignment. Teachers granted leave for Once a teacher has successfully bid on a position at the following year Job Fair, he/she may not bid on positionsany subsequent positions at that Job Fair. HoweverIn addition, this shall the successful bidder may not apply reverse his/her bid after being awarded the assignment.
