VACANCIES, TRANSFERS AND ASSIGNMENTS. A. A “vacancy” is defined as a newly-created position within a classification that is represented by the Association or a present position within a classification that is represented by the Association and which becomes vacant by reason of permanent separation (resignation, retirement, death, discharge or voluntary leave of one (1) or more years) of the bargaining unit member formerly in that position. The employer shall not be required to fill job vacancies where the job is eliminated pursuant to reduction in force or attrition. B. Vacancies shall be posted for not less than five (5) workdays in a conspicuous place in each school building before permanent filling of the vacancy. Bus route vacancies will be posted at the bus garage only. Interested bargaining unit members may apply in writing to the Superintendent or designee, within the five (5) workday posting period. The Employer shall notify bargaining unit employees of vacancies occurring during the summer months (June, July and August) by posting the vacancy on the website and/or emailing Association employees. 1. The posting shall consist of: Type of work/classification Location of work Starting date Hours to be worked Requirements and job qualifications Rate of pay The information listed on the job postings regarding location may vary. C. Positions under this Agreement shall be posted internally first. All applicants from the bargaining unit shall be considered for vacancies. If a bargaining unit employee is not offered a position applied for, he/she will be given an explanation. Transfer will be granted to the employee within the same classification with the most seniority, provided that he/she is equally or better qualified than less senior applicant(s). Note: See D.4 regarding exception to seniority rule. D. Bus Route Assignments: 1. Bus route vacancies will be posted as per Section B. 2. Bus route vacancies will be posted internally first as per Section C. 3. Assignment of noon runs will be done on an annual basis in the fall by seniority such that the noon driver with the most seniority as a noon driver will have the first choice. 4. Assignment of Special Routes will be decided such that the driver with the most seniority in that route will have first choice. However, the AM Technology Center run and the PM Technology Center run will be two separate assignments, requiring two different drivers. VACANCIES, TRANSFERS AND ASSIGNMENTS. 17.1 A vacancy shall be defined for purposes of this Agreement as a position presently unfilled, a position currently filled but which will be open in the future, or a new position that is currently not in existence. 17.2 The Board shall post and advertise any position for a minimum of five (5) work days, except in the case of an emergency, before filling a vacant position. Postings shall include location, hours, and minimum qualifications. Employees will be given preference for any vacancy if equally qualified with other applicants. In the event of multiple applications by employees of equally qualified persons, persons with seniority will be given preference. Nothing herein shall restrict the right of the Board to fill vacancies with temporary personnel pending appointment of a permanent person. During summer recess, a copy of all postings will be mailed and/or emailed to the Association president. 17.3 Employees may apply for vacancies by submitting an application to Human Resources with the supporting documentation requested in the job posting. 17.4 The district will notify the Association president of new hires and transfers at the beginning of each month with the following information: position, location, category, and step.

Length of continuing service with the District will not be considered a factor, unless all other factors are determined to be equal.

Notice of all vacancies in the bargaining unit shall be posted for at least five (5) working days. A posted vacancy will include the maximum number of hours, rate of pay and classification. Notice of postings will be displayed in prominent places on visible bulletin boards. The Association President will receive as many copies as requested for distribution. Employees interested must apply for the position within the five (5) working days of the posting period provided, however, the employer is not obligated to consider bids from employees who have bid on a position and successfully completed the probationary period set forth in Paragraph C of this Article anytime within the prior twelve (12) months, except in the event there are no other internal applicants, such an employee will be considered. The most highly qualified applicant for a particular vacancy will be selected by the district. However, when in the determination of the district, qualifications of both internal and external applicants are equal the internal applicant with most seniority will be granted the position. All applicants will be notified in writing of the district’s decision. Employees assigned to evening Custodial/Maintenance classification will be allowed to re-bid assignments once each year. The bid meeting will be the last week prior to the start of school. Descriptions of the work assignments will be available prior to the bid meeting. An employee may designate a proxy for the meeting. The bidding shall be based on seniority.

VACANCIES, TRANSFERS AND ASSIGNMENTS. A vacancy is an unfilled position within the District for which professional licensure is required by the applicable licensing board, and which the Board desires to fill. A change of assignment within a building does not constitute a vacancy. A vacancy is defined as: 1) A position not filled by reassignment within a building; 2) Transfer from building to building; 3) Newly created position/program. 1. Whenever a vacancy arises, the Superintendent or designee shall post in all school buildings, for a period of seven (7) working days, a list of known vacancies and emailed copies of such vacancies to the Association members. Staff members making application for vacant positions will be given consideration. Consideration means the staff member will be interviewed for the vacancy. 2. Members with specific interests in possible vacancies that occur after June 1 will notify the Superintendent of their interest, in writing, during the last regular week of school and shall include a summer address. 3. Should a vacancy occur, the members who have expressed an interest in said position shall be mailed a copy of the posting. 4. The members so notified shall have the responsibility of applying for the position. 5. Vacancies shall be filled on the basis of the experience, competency and qualifications of the applicant. 6. If a District employee applies for a vacancy and is not selected, they shall receive specific, constructive, written feedback with reasons for non-selection and offered a face-to-face meeting to review feedback. 7. The Council recognizes that when vacancies occur during the school year, it may be difficult to fill them from within the District without undue disruption to the existing instructional program. If the Superintendent, in their reasonable judgment, so determines, such a vacancy may be filled on a temporary or tentative basis until the end of the current semester at which time the position will be considered vacant.

Educator initiated transfers are those in which an educator requests a transfer from one building to another, one subject area or grade level to another, or to fill a vacated position. Transfer requests will be tendered from January 2 to February 1 annually. The district will provide a list of all transfer requests to building administrators. Administrators will set an interview with educators prior to the closing of a posted position. The district shall make a good faith effort to grant transfer requests. a. After February 1, educators not already on the transfer list will submit an application to any open positions for which they seek a transfer. After July 15 of each year, the transfer list will be dissolved. 2. In either case, if the educator is licensed for the position sought, the individual will be given an interview. Once a decision has been made on filling the position, all interviewed educators shall be notified of the decision prior to any general, public announcement. Any educator denied an educator-initiated transfer will be personally notified and will be given the reason(s) for denial in writing referencing the criteria listed in Paragraph D.
