JOB POSTING AND PROMOTION. 46.01 Public Service Commission job competitions received by the Employer and all vacancies for permanent or contractual positions of greater than twelve (12) weeks duration, either inside or outside the bargaining unit for which employees are eligible to apply, shall be posted in accessible places in the Employer's premises for a period of not less than seven (7) calendar days. 46.02 Postings of job competitions relating to bargaining unit positions shall contain the following: Title of position, minimum requirements of qualifications, education and skill. Minimum requirements shall not be established in an arbitrary or discriminatory manner. All postings shall state "This position open to male and female applicants". When a position requires the possession of a driver’s license or other specific requirement or training, the posting shall state this. 46.03 Applicants for positions will be considered in the following order: (1) Employees requesting transfer in accordance with Clause 46.04 (b) and subject to Clause 46.05 (a) and (b). (2) Employees of the Employer. (3) Applicants from outside the Bargaining Unit. (a) Qualifications and ability shall be the governing factors in considering candidates for appointment to positions in the Bargaining Unit posted in accordance with Clause 46.01 and Clause 10.02 (a) Where these factors are relatively equal between candidates, seniority shall apply. (b) Notwithstanding Clause 46.04 (a), when employees apply for a transfer to a vacant position in another Campus of the Employer, the employee with the greatest seniority shall be awarded the position provided it is similar to his/her current teaching position. (a) Subject to the provisions of Article 46, a permanent employee who applies for and is appointed to a temporary position with the Employer shall, subject to Article 50, return to his/her permanent position upon termination of the temporary position. Permanent status will be retained by the employee while in the temporary position. (b) When a permanent employee is given a temporary assignment into a temporary position, the permanent employee shall maintain his/her permanent status. (c) A permanent employee who has transferred to a temporary assignment or temporary position shall have contained within the letter of assignment or appointment reference to Clause 46.05 (a) or (b), as appropriate. (a) An employee who is requested to attend an interview by the Public Service Commission or the President of the College shall, with the prior approval of his/her immediate supervisor be awarded such time off with pay as is required for the purpose of attending the interview. (b) An employee required to attend an interview by the Public Service Commission or the President of the College shall be entitled to reimbursement of reasonable expenses necessarily incurred by him/her in attending such interview in accordance with the rules prescribed by the Treasury Board. 46.07 Notwithstanding the posting requirements of this Article, and where the parties mutually agree, provided there is no one on layoff, transfers or voluntary demotions may be granted without posting for the following reasons: (a) On compassionate or medical grounds, to permanent employees who have completed their probationary period. (b) Subject to 21.03 (a) and (b), to all employees who have become incapacitated by injury on duty or work related illness. 46.08 Members of the bargaining unit shall not be required to be included on job interviews.

JOB POSTING AND PROMOTION. 46.01 Public Service Commission job competitions received 12.01 Prior to the appointment to a vacant or new position covered by the Employer and Collective Agreement, PHABIS shall post notice of the vacancy on bulletin boards in all vacancies offices for permanent or contractual positions of greater than twelve (12) weeks durationdays. The posting shall contain: (i) the job title and description; (ii) the reporting line; (iii) the rate of pay and whether the position is full-time, either inside or relief; and (iv) the qualifications and experience required to perform the job. 12.02 Employees shall have the right to apply for such positions during the twelve (12) day posting period. The position will be filled from the applications received based on the qualifications, experience, skill and ability of the applicants. In cases where the factors are relatively equal, seniority shall govern. PHABIS will not consider the applications received from temporary employees hired from outside the bargaining unit for which unless there are no applications received from bargaining unit employees with the necessary qualifications, experience, skill and ability. If no applications are eligible received from employees with the necessary qualifications, experience, skill and ability, PHABIS may give consideration to apply, shall be posted in accessible places in persons outside the Employer's premises for a period of not less than seven (7) calendar daysbargaining unit. 46.02 Postings of job competitions relating to bargaining unit positions shall contain 12.03 A full-time, part-time or relief employee who is the following: Title of position, minimum requirements of qualifications, education and skill. The successful applicant shall assume his/her current teaching positionsame position on the incremental salary schedule unless the position is in a new classification in which case the successful applicant shall assume the entry level position on the incremental salary schedule. 12.04 A successful applicant to a vacant position shall be placed on an appropriate trial period of up to a maximum of five hundred and twenty (a520) Subject hours worked. PHABIS shall fill the applicant's previous position in accordance with Articles 12:01 and 12:02. If the employee's performance is unsatisfactory or the employee finds himself/ herself unable to perform the duties of the position during the trial period, he/she shall revert to the provisions of Article 46, a permanent position held immediately preceding such placement and the employee who applies for and is appointed to a temporary filling his/her position with the Employer shall, subject to Article 50, shall similarly return to his/her permanent former position. 12.05 When a position within the scope of this Collective Agreement has been vacant for a period of thirty (30) days, PHABIS will notify the Union of its decision to postpone, to fill or not to fill this position. 12.06 A “temporary vacancy” is one expected to exist for a duration of at least one (1) month and not more than three (3) months unless it is to fill a pregnancy or parental leave, leave of absence due to sickness or accident for which disability benefits or Workers' Compensation benefits are being received, or other leave of absence under Article 19 or a vacancy created because PHABIS has received funding to care for a specific client on a fee for service basis or it is mutually agreed by the parties hereto to extend the aforesaid duration. Such agreement shall not be unreasonably withheld. All temporary vacancies shall be posted with the approximate duration period. If the successful applicant comes from within the bargaining unit, then he/she upon termination completion of the temporary position. Permanent status will be retained by vacancy, shall revert to the employee while in the temporary position. (b) When a permanent employee is given a temporary assignment into a temporary position, the permanent employee shall maintain position held immediately preceding his/her permanent status. (c) A permanent employee who has transferred to a selection for the temporary assignment or temporary position shall have contained within the letter of assignment or appointment reference to Clause 46.05 (a) or (b), as appropriate. (a) An employee who is requested to attend an interview by the Public Service Commission or the President vacancy upon completion of the College shall, with temporary assignment. PHABIS shall not be obliged to continue the prior approval employment of his/her immediate supervisor be awarded such time off with pay as is required for the purpose of attending the interview. (b) An employee required to attend an interview by the Public Service Commission or the President of the College shall be entitled to reimbursement of reasonable expenses necessarily incurred by him/her in attending such interview in accordance with the rules prescribed by the Treasury Board. 46.07 Notwithstanding the posting requirements of this Article, and where the parties mutually agree, provided there is no one on layoff, transfers or voluntary demotions may be granted without posting for the following reasons: (a) On compassionate or medical grounds, to permanent employees who have completed their probationary period. (b) Subject to 21.03 (a) and (b), to all employees who have become incapacitated by injury on duty or work related illness. 46.08 Members of someone hired from outside the bargaining unit shall not be required to be included fill a temporary vacancy. 12.07 In the event that an employee applies for the same position on job interviewsmore than one (1) occasion during any thirty (30) day period, PHABIS may rely on the results of its interview with the Employee for the first position unless the Employee requests a second interview.
