(e) It is understood that should a temporary vacancy become permanent it will be posted again as a permanent position. .02 For members who are successful in promotion to a higher job classification, their new compensation rate shall be a minimum of 5% increase. The member’s new compensation rate will be that rate next above this 5% calculation in the salary grid for the new job classification. In no case will the new compensation rate be greater than the maximum rate for the Member’s new job classification. .03 The Employer may return a member promoted under .02 above, or to a position in management, office or other classification, to his/her former classification at any time after a minimum of 30 days to a maximum of 90 days if the employer considers that the member is unable to perform the work. Seniority of the returning member, for the purposes of lay-off, recall and posting will be adjusted by the time spent out of the bargaining unit. Any other appointment made as a result of the promotion will be reversed. .04 All unsuccessful members who have applied for a position will be notified of the following: (a) the status of their application and, (b) that a meeting may be arranged to discuss and receive feedback regarding their status in the competition and any general career or personal development information that may assist them when applying for future posting.

(60a) Employees, sessionals or part‐time employees in the bargaining unit, including those on lay‐off, applying for such openings will submit an application online through the Human Resources Working at Western website. The employer will provide support to enable members to complete their online application.
(b) All job postings will be posted for ten (10) working days or longerand will be posted on CUPE Local 2361 bulletin boards and on the UWO "Working at Western" website.

.01 To encourage motivation26.01 In making promotions within the bargaining unit, promote morale Management shall have due regard to seniority insofar as this is, in the opinion of Management, consistent with efficiency. When vacancies and create incentivenew classifications occur, the employees shall be notified by a posting which will state the vacancy that is open and the requirements necessary to fill the vacancy. The posting shall be given first opportunity displayed on notice boards throughout Transit Services' property for a minimum of a new or a vacant continuing or sessional position of sixty (60) days or longer.
(a) Such an employee, including an employee on layoff, may apply in confidence, for positions posted in accordance with Article 13 by applying during the seven (7) day posting period.
(b) Skillworking days during which time any employee may apply. The Management shall review all applications and if one is selected, ability and qualifications to perform the requirements of the position he/she shall be notified in writing, as well as a notice posted in the determining factor Department stating the employee selected. The unsuccessful applicants shall be notified before the vacancy is advertised outside of Transit Services. In all cases, preference shall be given to the senior employee in job postings, except the Department where the skillvacancy or new classification occurs, ability and qualifications of employee applicants are relatively equalproviding he/she has the necessary qualifications, in which case Seniority shall determine the successful employee applicant.
(c) A Sessional employee who is applying to a Continuing position in the same classification must successfully complete the interview and testing process and then the position will be awarded or if posted by bulletin throughout Transit Services' property to the Sessional senior employee who (based on Transit Services seniority), providing he/she has the most necessary qualifications. Employees selected to fill vacancies or new classifications will assume the new work for a trial period of two (2) months without loss of seniority. The disciplinary record filling of vacancies or new classifications shall be based on the following factors:
1) Seniority in the Department,
2) Possession of the necessary qualifications.
26.02 In accepting a transfer to another division within Transit Services, an employee will be considered placed at the bottom of the seniority list for that Department, but will retain his/her years of seniority for vacation entitlement.
26.03 If an employee who is covered by the Employer when awarding terms of this Collective Agreement on or after the position.
(d) If there effective date of this agreement, is no employee applicant promoted or transferred to a job with the skill, ability and qualifications to perform City of Guelph but outside the requirements of the position, UWO may fill the position from any source.
(e) It is understood that should a temporary vacancy become permanent it will be posted again as bargaining unit on a permanent position.
.02 For members who are successful basis, the employee shall retain his/her seniority in promotion his/her former job classification for ninety (90) days provided the employee pays dues, fines and assessments to a higher job classification, their new compensation rate shall be a minimum of 5% increasethe Union during this ninety (90) day period. The member’s new compensation rate will be that rate next above this 5% calculation in If the salary grid for the new job classification. In no case will the new compensation rate be greater than the maximum rate for the Member’s new job classification.
.03 The Employer may employee requests to return a member promoted under .02 above, or to a position in management, office or other classification, to his/her former classification at before he/she has completed ninety (90) days in his/her new job, the employee will be credited with his/her seniority accrued prior to his/her transfer from Local 1189, provided the employee paid his/her dues, fines and assessments to the Union. This opportunity will not be given more than once to any time after employee Should the employee decide to return to their bargaining unit position, they will assume their previously assigned run, provided they are returning within the same run sign-up. Should the employee return during a minimum subsequent sign-up, they will be placed on the spare board according to their seniority and assigned work according to spare board regulations.
26.04 When an Operator is required to serve in the capacity of 30 days acting supervisor, for an assigned period, he/she will not be detailed driving duties except in extreme circumstances. An operator assigned to a maximum supervise will not impose disciplinary action or be part of 90 days if the employer considers that the member is unable to perform the work. Seniority any part of the returning memberdisciplinary procedure, for the purposes of lay-off, recall and posting will be adjusted by the time spent out of the bargaining unit. Any other appointment made as a result of the promotion will be reversed.
.04 All unsuccessful members who have applied for a position will be notified of the following:
(a) the status of their application and,
(b) that a meeting but may be arranged required to discuss and receive feedback regarding their status in the competition and any general career or personal development furnish information during an investigation. It is not intended that may assist them when applying for future postingacting supervisors would aggressively pursue opportunities to administer discipline.
