Joint Motion If Settlement Not Completed Sample Clauses

The "Joint Motion If Settlement Not Completed" clause establishes a procedure for both parties to jointly request court action if a settlement agreement is not finalized by a specified deadline. In practice, this clause typically requires the parties to file a joint motion—such as a motion to restore the case to the court’s active docket or to set a new trial date—if they are unable to complete the settlement process within the agreed timeframe. Its core function is to ensure that legal proceedings can promptly resume if settlement efforts fail, thereby preventing unnecessary delays and maintaining the momentum of the case.
