Opt-Out Requirements. To opt out, members of the Trust Administration Class must submit to the Claims Administrator a written request for exclusion. The request for exclusion must include the individual’s full name, address, IIM Account number(s), Social Security Number, and a statement of the individual’s intention to opt out of the Settlement.

Opt-Out Requirements. Class Members may exclude themselves from the Settlement by advising the Class Administrator in writing no later than the Opt Out Deadline that they do not want to be a Class Member. All such writings must include the name and address of the individual opting out, and must be postmarked no later than the Opt Out Deadline. All Class Members will be bound by this Settlement and judgments of this Court in this Action unless they exclude themselves in writing by the Opt Out Deadline.
Opt-Out Requirements. (a) A Settlement Class Member who wishes to opt-out of the Settlement Class must do so in writing. To opt-out, a Settlement Class Member must complete and send to Class Counsel (or the Administrator), at the address listed in the Class Notice, a Request for Exclusion that is postmarked no later than the Opt-Out Deadline, as specified in the Class Notice (or as the Court otherwise requires). The Request for Exclusion must: (a) identify the case name; (b) identify the name, address, and telephone number of the Settlement Class Member; (c) be personally signed by the Settlement Class Member requesting exclusion; and (d) contain a statement that indicates a desire to be excluded from the Settlement Class in the Action, such as: “I hereby request that I be excluded from the proposed Settlement Class.” (b) Any Settlement Class Member who does not opt-out of the Settlement in the manner described herein shall be deemed to be part of the Settlement Class, and shall be bound by all subsequent proceedings, orders, and judgments, including the Final Approval Order. (c) A Settlement Class Member who desires to opt-out must take timely affirmative written action in accordance with this Section, even if the Settlement Class Member desiring to opt-out (a) files or has filed a separate action against any of the Released Parties, or (b) is, or becomes, a putative class member in any other class action filed against any of the Released Parties.

To be valid, a request for exclusion must: (a) contain a statement that the Settlement Class Member wishes to be excluded from the Settlement Class; (b) be personally signed and dated by the Settlement Class Member; and (c) provide the Settlement Class Member’s full name, mailing address, email, and telephone number. 9.2.4. Because requests for exclusion must be personally signed, mass-generated exclusion requests are invalid and may be denied by the Settlement Administrator. 9.2.5. A request for exclusion that is sent to an address other than that of the Settlement Administrator designated in the Notice, or that is not postmarked within the time specified, shall be ineffective and the person serving such a request shall be deemed to be a member of the Settlement Class and thus bound as a Settlement Class Member by the Settlement Agreement, if approved.

No person in the Settlement Class, or any person acting on behalf of or in concert or participation with that person in the Settlement Class, may exclude any other person in the Settlement Class from the Settlement Class. Opt-Out Requests must identify and include: (i) the litigation as Xxxxxx Chiropractic v. GEICO, Case. 17-cv-62462-CMA- BSS; (ii) the Settlement Class Member's name, (iii) the Settlement Class Member's federal tax identification number (“TIN”) if an entity, or last four digits of the Settlement Class Member’s Social Security Number; (iv) the Settlement Class Member's address, (v) identifies by claim number the specific claim(s) that the Settlement Class Member seeks to exclude from the Settlement, (vi) a clear expression of the desire to Opt-Out and be excluded from the Settlement Class with substantially the following statement: “I request to be excluded from the Settlement in the Xxxxxx Chiropractic v. GEICO action; and (vii) the signature of the Settlement Cass Member or an authorized representative of the Settlement Class Member. No Opt-Out Request will be valid unless all of the information described in this paragraph is included. No Settlement Class Member shall be deemed Opted-Out of the Settlement Class through any purported “mass” or “class” Opt- Outs. A separate Opt-Out Request must be submitted by each person or entity requesting exclusion.

Exclusion requests must: (a) be personally signed by the person in the Debt Collection Settlement Class who is requesting exclusion; (b) include the full name and address of the person in the Debt Collection Settlement Class requesting exclusion; and (c) include the following statement: “I/we request to be excluded from the Debt Collection Settlement in the Ossola action.” No request for exclusion will be valid unless all of the information described above is included. No person in the Debt Collection Settlement Class, or any person acting on behalf of or in concert or participation with that person (including, but not limited to, an attorney) in the Debt Collection Settlement Class, may exclude any other person or any group of persons from the Debt Collection Settlement Class. If a Debt Collection Settlement Class Member is also a Telemarketing Settlement Class Member and he or she wishes to opt out of both or either of this Debt Collection Settlement and/or the Telemarketing Settlement, he or she must submit separate exclusion requests pursuant to each settlement.

If a person in the Settlement Class submits both an objection and an exclusion request, the person will be considered to have submitted an exclusion request (and not an objection) and will be excluded from the Settlement Class.
