Common use of Jury Duty and Subpoenaed Witnesses Clause in Contracts

Jury Duty and Subpoenaed Witnesses. A. A full-time employee who is summoned and reports for jury duty or is subpoenaed and reports as a witness in any judicial hearing, shall receive a leave of absence. The employee shall be paid by the Employer an amount equal to the difference between the employee's straight time hourly base rate for eight (8) hours and the daily jury duty fee or witness fee paid by the court or litigant (not including travel allowance or reimbursement of expenses), for each day on which he/she reports for or performs jury duty or acts as a witness and on which he/she otherwise would have been scheduled to work for the Employer. B. The Employer's obligation to pay an employee for jury duty or as a witness is limited to the number of working days the employee is required to serve. C. In order to receive payment, an employee must give the Employer prior notice that he/she has been summoned for jury duty or as a witness; he/she must furnish satisfactory evidence that he/she reported for or performed jury duty or appeared as a witness on the days for which he/she claims such payment; and he/she must furnish satisfactory evidence of the amount of the jury duty fee or witness fee he/she received.
