Common use of Jury Duty/Subpoenaed Witness Clause in Contracts

Jury Duty/Subpoenaed Witness. 38.01 Any seniority employee who is called to and reports for jury duty or is subpoenaed as a witness shall be compensated by the Company by being paid the difference between the employee's hourly rate and the rate paid by the Court per day for each day of jury duty or witness duty performed on which the employee otherwise would have been scheduled to work for the Company and does not work. Such compensation shall be payable only if the employee gives the Company prior notice of such jury duty or witness duty call and presents proper evidence as to the jury duty or witness duty performed. It is understood that if an employee is called and dismissed so that he/she can come in to work by noon, this will be expected of him/her.
