Juvenile Files. 1. The detaining officer will be responsible for ensuring that all juveniles (10 years of age and older) referred to the District Attorney's office are photographed and fingerprinted. 2. Photographs and fingerprint files ofjuveniles will be kept separate from those of adults and will be forwarded to DPS for inclusion in the Juvenile Justice Information System through use of the Criminal History reporting form. 3. Photograph and fingerprint files of all juveniles or records of juveniles are subject to inspection only by the following: a. The judge, probation officers, and juvenile court staff; b. An attorney for a party to the proceedings; c. Law enforcement officers in the discharge of their official duties; d. A public or private agency providing supervision of the child by the agreement of the juvenile court or having custody of the child by court order; or e. Any person, agency or institution with permission of the juvenile court. 4. A law enforcement officer may take temporary custody of a child to take fingerprints or the photograph of a child for comparison purposes if: a. The officer has probably cause to believe that the child has engaged in delinquent conduct; b. That fingerprints found during the investigation will be matched to the child's fingerprints; or c. The child's photograph will be of material assistance during the investigation. d. The child will be released as soon as the fingerprints or photographs have been taken. e. The fingerprints or photograph will be immediately destroyed if they do not lead to a positive comparison or identification. 5. The Support Services Manager will coordinate the storage and destruction of juvenile records to comply with State and Federal Laws.

The Trustee shall make such annual or other reports as may from time to time be required under any applicable state or federal statute or rule or regulations thereunder.

  • Miscellaneous The Vendor acknowledges and agrees that continued participation in TIPS is subject to TIPS sole discretion and that any Vendor may be removed from the participation in the Program at any time with or without cause. Nothing in the Agreement or in any other communication between TIPS and the Vendor may be construed as a guarantee that TIPS or TIPS Members will submit any orders at any time. TIPS reserves the right to request additional proposals for items or services already on Agreement at any time.

  • Entire Agreement This DPA and the Service Agreement constitute the entire agreement of the Parties relating to the subject matter hereof and supersedes all prior communications, representations, or agreements, oral or written, by the Parties relating thereto. This DPA may be amended and the observance of any provision of this DPA may be waived (either generally or in any particular instance and either retroactively or prospectively) only with the signed written consent of both Parties. Neither failure nor delay on the part of any Party in exercising any right, power, or privilege hereunder shall operate as a waiver of such right, nor shall any single or partial exercise of any such right, power, or privilege preclude any further exercise thereof or the exercise of any other right, power, or privilege.

  • Counterparts This Agreement may be executed in two or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.

  • IN WITNESS WHEREOF the parties hereto have executed this Agreement as of the date first above written.

  • Termination In the event that either Party seeks to terminate this DPA, they may do so by mutual written consent so long as the Service Agreement has lapsed or has been terminated. Either party may terminate this DPA and any service agreement or contract if the other party breaches any terms of this DPA.
