Late Payment; Suspension of Services. Any late payment will accrue interest charges at the rate of 1% of the outstanding balance per month, or the amount prescribed by law, whichever is lower. If Customer fails to make full payment of the fees set forth in the Ordering Document by more than thirty (30) days after the due date, upon written notice by Axway, Axway may , if such fees remain unpaid subsequent to such written notice, suspend the Customer’s right to use the relevant Services and/or the Product.

In absence of a timely notice of billing dispute in accordance with Section 9.3, amounts not paid on or before the Due Date shall be payable with interest at the Interest Rate from the Due Date until payment is received. In absence of a timely notice of billing dispute in accordance with Section 9.3, if a Customer has not paid an invoice (or undisputed portion thereof) by the date that is 60 Days after the Due Date, Ameresco may elect to suspend further provision of any or all Services to Customer.
