Lessor’s Agent. A Lessor’s agent under a listing agreement with the Lessor acts as the agent for the Lessor only. A Lessor’s agent or subagent has the following affirmative obligations: To the Lessor: A fiduciary duty of utmost care, integrity, honesty, and loyalty in dealings with the Lessor. To the Lessee and the Lessor:
a. Diligent exercise of reasonable skills and care in performance of the agent’s duties. b. A duty of honest and fair dealing and good faith. c. A duty to disclose all facts known to the agent materially affecting the value or desirability of the property that are not known to, or within the diligent attention and observation of, the Parties. An agent is not obligated to reveal to either Party any confidential information obtained from the other Party which does not involve the affirmative duties set forth above.

Lessor’s Agent. All rights and remedies of Lessor under this Lease or that may be provided by law may be executed by Lessor in its own name individually, or in the name of its agent, and all legal proceedings for the enforcement of any such rights or remedies, including those set forth in Article 14, may be commenced and prosecuted to final judgment and execution by Lessor in its own name or in the name of its agent.
Lessor’s Agent. Lessor hereby agrees that Lessee, as Lessor's agent, may acquire each Equipment Group pursuant to the terms and conditions set forth in this Lease Agreement.

Lessor’s Agent. Xxxxxxx X. Xxxxxxx, Xx. is hereby designated as Lessor’s Agent for all purposes under this lease and the rent specified hereunder shall be payable to Xxxxxxx X. Xxxxxxx and shall be mailed to: Xxxxxxx X. Xxxxxxx, Xx. 0000 Xxxx Xxxxxx Xxxx St. Xxxxxxx, Illinois 60174
Lessor’s Agent. The name and address for service of the lessor's agent is stated in this agreement for item 3.
Lessor’s Agent. Lessor may be represented by a real estate licensee (agent) who is subject to the provisions of the real estate laws or the state. It is acknowledged and agreed that such agent for Lessor only acts for Lessor and is not representing Lessee in any capacity. Lessee acknowledges and under- stands that such agent, unless otherwise stated in writing, represents Lessor as a fiduciary and that Lessee is only being treated as a customer of Lessor. All obligations of this Agreement are the responsibility to Lessor not its agent. Lessor may hav e such agent act in its behalf but such shall not grant Lessee and rights against agent. Any agent for Lessor shall accrue and benefit for the covenants, waivers, releases, and indemnifications contained in the Agreement documents to the same extent as Lessor. Lessee understand that if an agent is involved in the transaction, that they have received written authority to act in all matters concerning this tenancy as Lessor’s authorized agent and represents Lessor as fiduciary. Lessee acknowledges they have chosen not to obtain a real estate licensee to represent them in this transaction.
Lessor’s Agent. Paragraph 4 of the Lease appointing the President of the University of Arizona as Xxxxxx’s agent thereunder, is hereby amended to provide that, notwithstanding such appointment --
a. The Annual Report described in paragraph 5(c) of the Lease shall be filed with the Executive Director of the Board of Regents.
x. Xxxxxx’x agent may not approve any new Sublease under paragraph 8 of the Lease in excess of 25,000 square feet, or any renewal of any Sublease in excess of 50,000 square feet, unless such new Sublease or renewal of Sublease has been reviewed by the Capital Committee of the Board of Regents. Xxxxxx’s agent may not approve any Ground Sublease under paragraph 8 of the Lease unless such Sublease has been reviewed by the Capital Committee of the Board of Regents. To the extent that the term of any such Ground Sublease extends beyond the Expiration Date, approval by the Board of Regents shall be required either to extend the Term with respect to such parcel or otherwise to recognize the leasehold.
d. Lessee’s articles of incorporation or by-laws shall provide that Xxxxxx’s Agent shall have the power to appoint three members of Xxxxxx’s board of directors, and that the President of the Arizona Board of Regents shall appoint one member of the Lessee’s Board of Directors, and that the appointee of the President of the Arizona Board of Regents shall also serve on Xxxxxx’s Executive Committee
