Lessor’s Agent. A Lessor’s agent under a listing agreement with the Lessor acts as the agent for the Lessor only. A Lessor’s agent or subagent has the following affirmative obligations: To the Lessor: A fiduciary duty of utmost care, integrity, honesty, and loyalty in dealings with the Lessor. To the Lessee and the Lessor: a. Diligent exercise of reasonable skills and care in performance of the agent’s duties. b. A duty of honest and fair dealing and good faith. c. A duty to disclose all facts known to the agent materially affecting the value or desirability of the property that are not known to, or within the diligent attention and observation of, the Parties. An agent is not obligated to reveal to either Party any confidential information obtained from the other Party which does not involve the affirmative duties set forth above.

All rights and remedies of Lessor under this Lease or that may be provided by law may be executed by Lessor in its own name individually, or in the name of its agent, and all legal proceedings for the enforcement of any such rights or remedies, including those set forth in Article 14, may be commenced and prosecuted to final judgment and execution by Lessor in its own name or in the name of its agent.
Lessor’s Agent. Lessor hereby agrees that Lessee, as Lessor's agent, may acquire each Equipment Group pursuant to the terms and conditions set forth in this Lease Agreement.

Lessor hereby represents to Lessee that Lessor's agent with respect to any and all matters regarding the Lease, this Amendment, the Building and the New Premises is Xxxxxxxxxx & Associates L.L.C. Lessee shall direct any and all notices or other correspondence under the Lease or this Amendment to Xxxxxxxxxx & Associates L.L.C. at the address to which Lessee makes its rent payments.
