Library Contribution. 5.1 The [Owner(s)/Developer] covenants to pay to the County Council the Library Contribution prior to [the first Occupation of the first (1st) Dwelling].
5.2 The [Owner(s)/Developer] hereby covenants not to Occupy or permit Occupation of [any Dwellings] until the Library Contribution has been paid to the County Council.
Library Contribution. The County Council to use the Library Contribution for the provision of [insert use of contribution] at [insert place where contribution will be spent].
Library Contribution. The Owner covenants with the County Council
Library Contribution. The Developer covenants with the County Council to pay a Library Contribution to the County Council on each Quarter Day in respect of each Residential Unit occupied in the period from the preceding Quarter Day.
Library Contribution. The County Council covenants with the Developer to apply the Library Contribution (and each insta lment of the Library Contribution) only towards the provision of Library services available to resid ents of the Development or otherwise having a spatial or functional relationship with the Develo pment.
Library Contribution. 2.1. To pay to the County Council prior to the Commencement Date the Library Contribution Index Linked
2.2. Not to cause or allow the Commencement of the Development to occur until the Library Contribution and any Indexation and Interest payable under this Deed has been paid to the County Council.
2.3. If the Library Contribution is not paid to the County Council on or before the relevant payment date, to pay to the County Council in addition Interest from the relevant payment date until the actual date of payment pursuant to Clause 11 and any such Interest shall be treated as part of the Library Contribution.
Library Contribution. To expend the Library Contribution together with any interest accruing thereon only on additional stock at East Xxxxxxxxx Library.
Library Contribution. 3.1 To pay the Library Contribution to the County Council prior to the Commencement Date.
3.2 Not to Commence the Development until the Library Contribution has been paid in accordance with paragraph 3,1 of this Schedule.
Library Contribution a. The Library will procure a general contractor, in accordance with Ohio Revised Code Section 3375.41, to construct the Project and the Library will prepare and hold a lump sum contract with such general contractor, as the Owner of the Project. In its sole discretion the Library may procure a general contractor for the Project in any manner in accordance with Ohio law, reject any or all bids or proposals received for the Project, accept any bid or proposal received for the Project, and may engage in one or more procurement processes for the Project, without invalidating this Agreement.
b. To the extent the contract sum under the Library’s agreement for construction of the Project exceeds the City’s contributed sum of $450,000, the Library will contribute the remaining funds required to construct the Project pursuant to such agreement.
c. Except as may otherwise be provided for in this Agreement, the Library will have independent and full powers to manage the Project, make any and all decisions relating to the Project in its sole discretion but will name the City as a third-party beneficiary to the general contractor agreement.
d. The Library will also require the general contractor to name the City as an additional insured on applicable insurance policies relating to the Project.
e. Notwithstanding any other provision in this Agreement to the contrary, the Library is not obligated to enter into an agreement for construction of the Project, in its sole discretion.
Library Contribution. 2.1. The Owner covenants to pay the Library Contribution to the County Council prior to Occupation of the 750th Residential Unit.
