Light Duty and Limited Duty. An administrator who has been absent by reason of sickness or injury may, upon the recommendation of a physician but at the sole discretion of Management, return to work for light and limited duty upon such terms and conditions as Management shall determine. Whenever Management shall have offered to permit any such administrator to return to work for limited duty and such offer is made in accordance with the recommendation of any physician, the failure of such administrator to return to work in accordance with such offer shall be grounds for the taking of disciplinary action. For the purposes of this Section, Management may require that an administrator submit to a physical examination by a physician designated by Management for such purposes. Such examination shall be at the expense of the University. At such examination the administrator may, upon his own request and at his own expense, be represented by a personal physician. The administrator shall cooperate with the physician appointed to conduct the medical examination and, for that purpose, shall authorize and direct the release to such physician, and shall waive any right of confidentiality (including any right under HIPPA) in connection with all medical records that the physician judges to be relevant to the conduct of such examination and to an assessment of the administrator’s medical condition.
