Linear Infrastructure Construction and Operation. ‌ Linear infrastructure (i.e. midstream and gathering pipelines, electrical transmission and distribution infrastructure, and other utilities) construction and operation for industrial purposes will be a Covered Activity if conducted in accordance with applicable statutory and regulatory standards and the Conservation Measures described in this agreement. This activity includes land surveying, construction, routine operation, maintenance and repairs, emergency response activities, reclamation activities for pipeline and appurtenant structures (e.g., pipe yards, interconnects, compressor stations) and electric utility facilities (e.g., transmission lines, distributions lines, service lines, and substations).

Linear Infrastructure Construction and Operation. Linear infrastructure (i.e. midstream and gathering pipelines, electrical transmission and distribution infrastructure, and other utilities) construction and operation for industrial purposes will be a Covered Activity if conducted in accordance with applicable statutory and regulatory standards and the Conservation Measures described in this agreement. This activity includes land surveying, construction, routine operation, maintenance and repairs, emergency response activities, reclamation activities for pipeline and appurtenant structures (e.g., pipe yards, interconnects, compressor stations) and electric utility facilities (e.g., transmission lines, distributions lines, service lines, and substations). Pipeline rights-of-way are typically 50 feet wide, while rights-of-way for electrical transmission and distribution facilities vary in width depending upon the size of the facility. Construction of pipelines necessitates: (1) the staging and storage of equipment, materials, and vehicles; (2) clearing of rights-of-way; (3) trenching for the pipeline; and

  • PRE-CONSTRUCTION PHASE SERVICES The Pre-Construction Phase shall be deemed to commence upon the date specified in a written Notice to Proceed with Pre-Construction Phase Services issued by Owner and shall continue through completion of the Construction Documents and procurement of all major Subcontractor agreements. Contractor is not entitled to reimbursement for any costs incurred for Pre-Construction Phase Services performed before issuance of the written Notice to Proceed. Pre-Construction Phase Services may overlap Construction Phase Services. Contractor shall perform the following Pre-Construction Phase Services:

  • Pre-Construction Phase Employer’s Liability, Workers’ Compensation, Comprehensive General Liability and Comprehensive Automobile Liability in the amounts as set forth in the UGSC.

  • Routine Maintenance, Construction, and Repair The NYISO or Connecting Transmission Owner may interrupt interconnection service or curtail the output of the Small Generating Facility and temporarily disconnect the Small Generating Facility from the New York State Transmission System or Distribution System when necessary for routine maintenance, construction, and repairs on the New York State Transmission System or Distribution System. The NYISO or the Connecting Transmission Owner shall provide the Interconnection Customer with five Business Days notice prior to such interruption. The NYISO and Connecting Transmission Owner shall use Reasonable Efforts to coordinate such reduction or temporary disconnection with the Interconnection Customer.

  • Interconnection Facilities Engineering Procurement and Construction Interconnection Facilities, Network Upgrades, and Distribution Upgrades shall be studied, designed, and constructed pursuant to Good Utility Practice. Such studies, design and construction shall be based on the assumed accuracy and completeness of all technical information received by the Participating TO and the CAISO from the Interconnection Customer associated with interconnecting the Large Generating Facility.

  • BUILDER’S RISK FOR NEW CONSTRUCTION PROJECTS If the project is NEW CONSTRUCTION, then the following provisions apply:

  • PRE-CONSTRUCTION PHASE FEE The Pre-Construction Phase Fee is the total compensation payable to Contractor for the performance of Pre-Construction Phase Services, except for Additional Pre-Construction Phase Services approved in advance and in writing by Owner. The Pre-Construction Phase Fee shall be a lump sum amount based on the AACC established in this Agreement.

  • Project Construction The Contractor agrees to provide continuous on-site supervision on each Job Order, while progress on the project is being accomplished. The Contractor’s Project Manager will ensure:

  • Pre-Construction Conference Participate in a pre-construction conference prior to commencement of Work at the Site.

  • Participating TO's Interconnection Facilities Construction The Participating TO's Interconnection Facilities shall be designed and constructed in accordance with Good Utility Practice. Upon request, within one hundred twenty (120) Calendar Days after the Commercial Operation Date, unless the Participating TO and Interconnection Customer agree on another mutually acceptable deadline, the Participating TO shall deliver to the Interconnection Customer and the CAISO the following “as-built” drawings, information and documents for the Participating TO's Interconnection Facilities [include appropriate drawings and relay diagrams]. The Participating TO will obtain control for operating and maintenance purposes of the Participating TO's Interconnection Facilities and Stand Alone Network Upgrades upon completion of such facilities. Pursuant to Article 5.2, the CAISO will obtain Operational Control of the Stand Alone Network Upgrades prior to the Commercial Operation Date.

  • Contract Construction 6.27.1 The parties acknowledge that each party and its counsel have reviewed this CONTRACT and that the normal rule of construction to the effect that any ambiguities are to be resolved against the drafting party shall not be employed in the interpretation of this CONTRACT or any amendment or exhibits hereto.
