Common use of Long Lead-Time Items Clause in Contracts

Long Lead-Time Items. The XXXX contractor shall be solely responsible for and identify and recommend to the Owner a schedule for procurement of materials and/or equipment requiring extended delivery times and advise Owner on expedited procurement of those items to meet the project schedule and minimize risk of cost escalation. The XXXX contractor shall advise Owner and Designer on the preparation of performance specifications and requests for technical proposals for the procurement and installation of systems and components and for the procurement of long lead items. If requested by Owner and subject to the Owner’s prior written approval, issue requests for technical proposals to qualified sources and receive proposals and assist in their evaluation. If such long-lead-time items are procured by the Owner, they shall be procured on terms and conditions mutually acceptable to the XXXX contractor and Owner. Upon the Owner's acceptance of the XXXX contractor’s GMP proposal, the Owner shall assign all contracts for such items to the XXXX contractor, who shall accept responsibility for such items as if procured by the XXXX contractor. The XXXX contractor shall expedite the delivery of long-lead-time items and assume all risk associated with on-site storage and cost escalation. With the specific written approval of the Owner and/or Designer, the XXXX contractor shall, when reasonably required to maintain the Project schedule, be permitted to contract with subcontractors and to enter into contracts to secure long-lead time items prior to the Owner’s acceptance of the XXXX contractor’s GMP proposal for the Project.
