Sustainability Requirements. All rehabilitation, reconstruction, and new construction must be designed to incorporate principles of sustainability, including water and energy efficiency, resilience, and mitigating the impact of future disasters. Wherever feasible, the Subrecipient, Subrecipient’s Developers and Contractors must follow best practices, such as those provided by the U.S. Department of Energy, Home Energy Professionals: Professional Certifications and Standard work specifications.

Sustainability Requirements. 1.2.1 This Project shall be designed and constructed in accordance with the requirements of Am. Sub. H.B. 251 of the 126th General Assembly and resulting rules, policies, and procedures adopted by the Commission establishing Sustainability Requirements for Capital Improvements Projects, including applicable provisions of OAC 3318-3: 1.2.1.1 The A/E shall incorporate cost-effective, energy-efficient, green-building practices to the maximum extent possible into the Project. 1.2.1.2 If the Owner is an agency of the state of Ohio, the A/E shall design new construction so that fossil-fuel, greenhouse gas emitting, energy consumption of the facility is reduced by 65 percent, as compared to the regional average for that building type as evidenced by the U.S. Environmental Protection Agency’s Target Finder calculator. 1.2.1.3 If the Owner is an agency of the state of Ohio, the A/E shall design renovations so that fossil-fuel, greenhouse gas emitting, energy consumption of the facility is reduced by 50 percent, as compared to the regional average for that building type as evidenced by the U.S. Environmental Protection Agency’s Target Finder calculator. 1.2.1.4 The Owner may apply to the Commission for a waiver of compliance with the requirements of Section 1.2.1. 2, Section 1.2.1.3, or both.
Sustainability Requirements. As used in this Lease, “Sustainability Requirements” means any and all Laws relating to any “green building” or other environmental sustainability practices and requirements now or hereafter in effect or imposed by any governmental authority or applicable Laws from time to time (“Sustainability Requirements”). Without limiting the scope of any Sustainability Requirements that may be in effect from time to time, Tenant acknowledges that Sustainability Requirements may address whole-building or premises operations, construction issues, maintenance issues and other issues, including without limitation requirements relating to: chemical use; indoor air quality; energy and water efficiency; recycling programs; interior and exterior maintenance programs; systems upgrades to meet green or sustainable building energy, water, air quality, and lighting performance standards; construction methods and procedures; material purchases; disposal of garbage, trash, rubbish and other refuse and waste; and the use of proven energy and carbon reduction measures. Neither Tenant nor Tenant’s Agents shall use or operate the Premises in a manner that will cause any part of the Project to be in non-compliance with any Sustainability Requirements in effect from time to time.

Sustainability Requirements. Developer shall use commercially reasonable efforts to secure certification of the Project from the US Green Building Council under the LEED™ for Neighborhood Development (based on the standards in effect as of the Reference Date). Before the Outside Date for submittal of a Major Phase Application for Major Phase 2, Developer shall submit a completed application for LEED certification to the US Green Building Council and provide a progress report to the Agency on the status of the certification process upon request. Certain other sustainability requirements that have been incorporated into the design of the Project are set forth on Exhibit K.
