Common use of Maintenance Plans Clause in Contracts

Maintenance Plans. (a) No later than 90 days prior to the first Substantial Completion Date, Project Co shall submit to the IO Representative for review pursuant to Schedule 10 - Review Procedure, the Preventive Maintenance Plan for the first Contract Year and the Five Year Maintenance Plan for the first 5 Contract Years, and shall update such plans as provided for in the Output Specifications annually thereafter. (b) Project Co shall perform the Maintenance Work as identified in the Preventive Maintenance Plan, and, without limiting Project Co’s other obligations in respect of the performance of the Project Operations, shall undertake all Maintenance Work: (i) in accordance with the Output Specifications; (ii) at the times scheduled for such Maintenance Work; (iii) in accordance with Good Industry Practice; (iv) in a manner that allows the Facilities to remain operational at all times; and (v) otherwise in accordance with the Preventive Maintenance Plan.

(b) Project Co shall perform the Maintenance Work as identified in the Preventive Scheduled Maintenance Plan, and, without limiting Project Co’s 's other obligations in respect of the performance of the Project Operations, shall undertake all Maintenance Work: (i) in accordance with the Output Specifications; (ii) at the times scheduled for such Maintenance Work; (iii) in accordance with Good Industry Practice; (iv) in a manner that allows the Facilities Facility to remain operational at all times; and (v) otherwise in accordance with the Preventive Scheduled Maintenance Plan.
