Mandatory Compensation for Expropriation. This provision gives foreign investors a right to compensation when a government directly or indirectly “expropriates” their investments or profits or takes an action that has the “equivalent effect” of expropriation. Under the MAI, expropriation or nationalization of investments would not be permitted, except for purposes which are in the public interest, carried out on a non- discriminatory basis, in accordance with due process of law and accompanied by prompt, adequate and effective compensation.22 Due process in this context means the ability of the investor to obtain judicial review in relation to the value of its investment and the payment of compensation from the relevant authorities of the host state.23 Compensation must be paid without delay, be equivalent to the fair market value of the expropriated investment and be fully transferable.24
