Furthermore, except in the case where Owner specifically authorizes disclosure of Owner’s confidential information in writing, ESCO shall maintain the confidentiality of Owner’s information pertaining to the Project, unless withholding such information would violate the law, create the risk of significant harm to the public or prevent ESCO from establishing a claim or defense in an adjudicatory proceeding. ESCO shall require of its subcontractors similar agreements to maintain the confidentiality of Owner’s information.

Information provided pursuant to this requirement will be used for the administration of state, federal and local tax laws. Owner may report the information to the Oregon Department of Revenue and Internal Revenue Service (“IRS”) under the name and TIN provided.
A. Any individual signing on behalf of ESCO hereby certifies under penalty of perjury: (1)ESCO has provided its correct TIN to Owner.
