Common use of Members Eligible for Leave Clause in Contracts

Members Eligible for Leave. A member is eligible for leave if the member: a) has been employed for at least 12 months; b) has actually worked at least 1,250 hours during the 12 month period immediately preceding the commencement of the leave (full-time teachers who instruct students are presumed to meet this hours-worked requirement unless the District can show that the teacher did not actually work 1250 hours); and c) has not taken twelve (12) workweeks of FMLA or CFRA leave in that fiscal year (July 1 through June 30).
