Merit pay criteria. The Council of Deans together with three (3) Faculty Members nominated by the Faculty Senate shall develop the criteria to be used in the first year only and shall submit those criteria to the Xxxxxxx no later than October 30, 2010. The criteria must recognize teaching, research, and service as areas of endeavor to be considered in the award of merit increases. The criteria must be flexible enough to be adaptable to the different missions of the different colleges. The criteria will be subject to approval by the Xxxxxxx and, once final, will be published and distributed to Faculty Members not later than November 15, 2010.

Merit pay criteria. The Faculty Members of the individual Academic Units shall develop merit criteria consistent with their unit’s RPT criteria. The criteria must recognize teaching, research, and service as areas of endeavor to be considered in the award of merit increases. The Academic Unit Faculty Members shall submit the criteria for approval by that unit’s Xxxx; the Xxxxx shall submit the criteria for approval by the Xxxxxxx. Once final, each unit’s criteria must be published and distributed to Faculty Members. The same criteria shall be used in both 2011-12 and 2012-13.

Notwithstanding the foregoing, the parties hereby acknowledge that any party’s failure (or lack thereof) to meet the provisions of the Service Level Agreement, while not in and of itself a breach of contract giving rise to contractual or other remedies, may factor into the Trust’s reasonably determined belief regarding the standard of care exercised by State Street hereunder.
