Mitigation Must Enhance Program Capacity. Mitigation must be directed toward a program capacity improvement identified in the School District’s 5-Year District Facilities Work Program, which satisfies the demands created by the proposed development consistent with the adopted LOS standards. Mitigation shall be directed to projects in the School District’s 5-Year District Facilities Work Program that the School Board agrees will satisfy the demand created by that development approval and shall be assured by a legally binding agreement consistent with Section 163.3180, between the School Board, the Local Government, and the applicant which shall be executed prior to the Local Government’s issuance of the final development order. If the School Board agrees to the mitigation, the School Board must commit in the agreement to placing the project required for mitigation in its 5-Year District Facilities Work Program.
