Moderately Priced Dwelling Units. In accordance with the provisions of Section 1-6A-5.1(G) of the County Code regarding moderately priced dwelling units (“MPDUs”), Developer hereby elects to utilize, and the BOCC agrees to permit Developer to utilize, the Payment in Lieu of Building MPDUs as provided in Section 1-6A-5.1 aforesaid, as in existence as of the date hereof, in lieu of the prior MPDU requirements for a residential developer. A draft Moderately Priced Dwelling Unit Payment In Lieu Agreement is attached hereto and made part hereof as EXHIBIT 6.

Moderately Priced Dwelling Units. In lieu of providing 12.5% of the total dwelling units constructed on the Property as MPDU’s, as required by County law, the Charitable Foundation shall have the option of paying a fee in lieu of providing MPDU’s pursuant to Section 1-6A-5.1 of the MPDU Ordinance, and the BOCC agrees to permit the Charitable Foundation to utilize the payment in lieu of building MPDUs instead of building MPDUs as required under 1-6A-5 of the MPDU Ordinance. A draft MPDU Agreement is attached hereto and made a part hereof as Exhibit “6”.
Moderately Priced Dwelling Units. 4.1 Pursuant to Ordinance No. 00-00-000, enacted by the BOCC on September 6, 2011, the Developer shall be entitled to pay a “per dwelling unit payment in lieu” for all residential units in the PUD subject to the County’s Moderately Priced Dwelling Units regulations (“MPDU”) codified as Chapter 1-6A of the Xxxxxxxxx County Code. Ordinance No. 00-00-000 is attached hereto as EXHIBIT 9 and made a part hereof. Notwithstanding a sunset provision of Ordinance No. 00-00-000 of five years from the effective date, this Section 4.1 shall survive the sunset of the Ordinance and shall run with the full term of this Agreement and any duly approved extensions thereof.

Except as expressly provided in this Agreement to the contrary, any reference to “Units” shall include the Class A Units and any other Classes that may be established in accordance with this Agreement. All Units of a particular Class shall have identical rights in all respects as all other Units of such Class, except in each case as otherwise specified in this Agreement.

  • Layoff Units A. A layoff unit is defined as the entity or administrative/organizational unit within the Employer used for determining the available options for employees who are being laid off.

  • New Member Orientation The Employer will notify the Union of any newly represented temporary employees. Switched Exchange Access Service traffic is not Tandem Transit Traffic.

  • Unbundled Voice Loop – SL2 (UVL-SL2 Loops may be 2-wire or 4-wire circuits, shall have remote access test points, and will be designed with a DLR provided to NewPhone. SL2 circuits can be provisioned with loop start, ground start or reverse battery signaling. OC is provided as a standard feature on XX0 Xxxxx. The OC feature will allow NewPhone to coordinate the installation of the Loop with the disconnect of an existing customer’s service and/or number portability service. In these cases, BellSouth will perform the order conversion with standard order coordination at its discretion during normal work hours.

  • Target Population The Grantee shall ensure that diversion programs and services provided under this grant are designed to serve juvenile offenders who are at risk of commitment to Department.
