Moving to a category with lower level of protection If the Account holder is classified as a 'retail client', they may request in writing that the Bank treat them as a 'professional client' either generally or for specified financial instruments, investment services or transactions. The Bank may, at its sole discretion, decide not to accede to such a request. If the Bank decides to consider a request to change category, it shall check whether the Account holder meets the objective criteria for moving to a higher category. The Bank will also assess the Account holder’s level of expertise, experience and knowledge as well as any factor that it deems appropriate to ensure that they can take their own investment decisions and understand the risks involved. The Bank will give the Account holder a clear written warning of the protections they may lose. The Account holder must state in writing, in a document that is separate from this agreement, that they are aware of the consequences of waiving the aforementioned protections. The Bank undertakes to inform the Account holder in advance of their category change.
