Neighborhood Parks; Cost and Terms Sample Clauses

Neighborhood Parks; Cost and TermsDeveloper shall construct neighborhood park land improvements in accordance with the following provisions: a. The construction of the neighborhood parks shall be consistent with the recreation standards in the parks master plan as may be adopted by City, and with the Tentative Map conditions of approval and the Infrastructure Financing Plan. b. Developer shall commence design of the neighborhood park labeled “Lot D” on the Tentative Map no later than issuance of the 20th building permit for the Project. Following approval of the neighborhood park design for “Lot D” by City, Developer shall be obligated to begin construction thereof no later than issuance of the 75th building permit for the Project. c. Developer shall commence design of the neighborhood park labeled “Lot G” on the Tentative Map no later than issuance of the 20th building permit for the Project. Following approval of the neighborhood park design for “Lot G” by City, Developer shall be obligated to begin construction thereof no later than issuance of the 200th building permit for the Project. d. Following the commencement of construction of any neighborhood park pursuant to subsection (c) above, Developer shall exert commercially reasonable efforts to complete the construction of said neighborhood park within one (1) year, but may request an extension of such time from City, which shall not be denied without reasonable cause.

Following the commencement of construction of any neighborhood park pursuant to subsection (c) above, Developer shall exert commercially reasonable efforts to complete the construction of said neighborhood park within one (1) year, but may request an extension of such time from City, which shall not be denied without reasonable cause.

Following the commencement of construction of any neighborhood park pursuant to subsection (c) above, Developer shall exert commercially reasonable efforts to complete the construction of said neighborhood park within one (1) year, but may request an extension of such time from City, which shall not be denied without reasonable cause.

Developer shall commence construction of the neighborhood park labeled “Park 1” on the Large Lot Map no later than issuance of fifty percent (50%) of the building permits are issued within that portion of the Project identified as MDR within the General Development Plan. d. Following the commencement of construction of any neighborhood park pursuant to subsection (c) above, Developer shall exert commercially reasonable efforts to complete the construction of said neighborhood park within one (1) year, but may request an extension of such time from City, which shall not be denied without reasonable cause.

  • Interconnection Facilities Engineering Procurement and Construction Interconnection Facilities, Network Upgrades, and Distribution Upgrades shall be studied, designed, and constructed pursuant to Good Utility Practice. Such studies, design and construction shall be based on the assumed accuracy and completeness of all technical information received by the Participating TO and the CAISO from the Interconnection Customer associated with interconnecting the Large Generating Facility.

  • General Description of Facilities Subject to and upon the terms and conditions herein set forth, (i) the Revolving Lenders hereby establish in favor of the Borrower a revolving credit facility pursuant to which each Revolving Lender severally agrees (to the extent of such Revolving Lender’s Revolving Commitment) to make Revolving Loans to the Borrower in accordance with Section 2.2; (ii) each Issuing Bank may issue Letters of Credit in accordance with Section 2.22; (iii) the Swingline Lender may make Swingline Loans in accordance with Section 2.4; and (iv) each Revolving Lender agrees to purchase a participation interest in the Letters of Credit and the Swingline Loans pursuant to the terms and conditions hereof; provided that in no event shall the aggregate principal amount of all outstanding Revolving Loans, Swingline Loans and outstanding LC Exposure exceed the Aggregate Revolving Commitment Amount in effect from time to time.

  • Scope of Services and Term Subject to the provisions for early termination as set forth herein, the Contractor agrees that it will perform the Services enumerated in the scope of services attached hereto as Exhibit A and incorporated herein by reference (the “Scope of Services”) for a term of three (3) years beginning , 2024 through , 2027 (the “Term”). The Authority in its sole discretion may extend the Agreement for two (2) additional one-year periods, for a potential maximum term of five (5) years. The Authority will provide any such renewal notice in writing at least thirty (30) days prior to expiration of the Agreement. The maximum payment for the Term is set forth in Section II(a). All work shall be diligently performed by the Contractor in an economical, expeditious and professional manner.

  • Effective Date and Term of Agreement This Agreement is effective and binding on the Company and Employee as of the date hereof; provided, however, that, subject to Section 2(d), the provisions of Sections 3 and 4 shall become operative only upon the Change in Control Date.

  • Project Description In two or three brief sentences, provide a concise description of your exhibition. Include the subject matter, type of objects to be included (paintings, sculpture, manuscripts, etc.), those responsible for organizing the exhibition, and catalogue author(s).

  • SCOPE OF ARCHITECT’S BASIC SERVICES 3.1 The Architect’s Basic Services consist of those described in this Article 3 and include usual and customary structural, mechanical, and electrical engineering services. Services not set forth in this Article 3 are Supplemental or Additional Services. § 3.1.1 The Architect shall manage the Architect’s services, research applicable design criteria, attend Project meetings, communicate with members of the Project team, and report progress to the Owner. § 3.1.2 The Architect shall coordinate its services with those services provided by the Owner and the Owner’s consultants. The Architect shall be entitled to rely on, and shall not be responsible for, the accuracy, completeness, and timeliness of, services and information furnished by the Owner and the Owner’s consultants. The Architect shall provide prompt written notice to the Owner if the Architect becomes aware of any error, omission, or inconsistency in such services or information. § 3.1.3 As soon as practicable after the date of this Agreement, the Architect shall submit for the Owner’s approval a schedule for the performance of the Architect’s services. The schedule initially shall include anticipated dates for the commencement of construction and for Substantial Completion of the Work as set forth in the Initial Information. The schedule shall include allowances for periods of time required for the Owner’s review, for the performance of the Owner’s consultants, and for approval of submissions by authorities having jurisdiction over the Project. Once approved by the Owner, time limits established by the schedule shall not, except for reasonable cause, be exceeded by the Architect or Owner. With the Owner’s approval, the Architect shall adjust the schedule, if necessary, as the Project proceeds until the commencement of construction. § 3.1.4 The Architect shall not be responsible for an Owner’s directive or substitution, or for the Owner’s acceptance of non-conforming Work, made or given without the Architect’s written approval. § 3.1.5 The Architect shall contact governmental authorities required to approve the Construction Documents and entities providing utility services to the Project. The Architect shall respond to applicable design requirements imposed by those authorities and entities. § 3.1.6 The Architect shall assist the Owner in connection with the Owner’s responsibility for filing documents required for the approval of governmental authorities having jurisdiction over the Project.

  • Project or Building Name and Signage Landlord shall have the right at any time to change the name of the Project or Building and to install, affix and maintain any and all signs on the exterior and on the interior of the Project or Building as Landlord may, in Landlord’s sole discretion, desire. Tenant shall not use the name of the Project or Building or use pictures or illustrations of the Project or Building in advertising or other publicity or for any purpose other than as the address of the business to be conducted by Tenant in the Premises, without the prior written consent of Landlord.

  • Office Facilities The University will endeavor to provide each member with an adequately furnished private office and will endeavor to provide a conference room in each major building.

  • PREVAILING WAGE RATES - PUBLIC WORKS AND BUILDING SERVICES CONTRACTS If any portion of work being Bid is subject to the prevailing wage rate provisions of the Labor Law, the following shall apply:

  • Operation and Maintenance Manuals Receipts for transmittal of Operation and Maintenance Manuals, Brochures and Data to the Design Professional (or Commissioning Agent) as required by Section 6.1.1.5.
