The new office component of the Project is the most speculative at this point, and therefore there are not Performance Milestones for the office space, nor is Developer in default if it fails to cause the completion of the new office/commercial space.

PROVIDER agrees to cooperate with the Auditor in the conduct of the audit or investigation, including without limitation, providing all records requested. PROVIDER will include this provision in all contracts with permitted subcontractors.
