Non-Discrimination Policy. State-Federal Law (A) The state and the Association shall not discriminate against any employee for any reason prohibited under Florida Statutes or any federal law. (B) The Association shall have the right to consult on issues of unlawful discrimination or sexual harassment with the Step 1 management representative and/or designee(s), up through the Step 2 management representative and/or designee(s), to the Secretary of the Department of Management Services or designee(s). (C) Any claim of unlawful discrimination or sexual harassment by an employee against the state, its officials or representatives, except for grievances related to Association membership, shall only be subject to the method of review prescribed by law or by rules and regulations having the force and effect of law. (D) Association claims of discrimination against the state, its officers or representatives shall be remedied only through the Public Employees Relations Commission or other such administrative proceedings provided by law.
