Notice; Exception. The termination of Abrika’ exclusive rights under Section 7.1 shall take effect thirty (30) days following its receipt of written notice from Corium (the “Exclusivity Notice Period”) indicating its intent to exercise its rights thereunder. Notwithstanding the foregoing, Exclusivity Termination shall not apply in the event that Abrika provides notice to Corium within the Exclusivity Notice Period that its failure to commence commercial sale or distribution is due to causes beyond its control, and that such causes are not likely to continue beyond the twelve month period of such notice.

Notice; Exception. The provisions of this section are not applicable with respect to employment taxes for any month in which the em- ployer receives notice that a return is required under § 31.6011(a)–5 (or for any subsequent month for which such a re- turn is required), if those taxes are also required to be deposited under the sep- arate accounting procedures provided in § 301.7512–1 of the Regulations on Procedure and Administration (which procedures are applicable if notifica- tion is given by the Commissioner of failure to comply with certain employ- ment tax requirements). In cases in which a monthly return is required under § 31.6011(a)–5 but the taxes are not required to be deposited under the separate accounting procedures pro- vided in § 301.7512–1, the provisions of this section shall apply except those provisions shall not authorize the xx- xxxxxx of any deposit to a date after the date on which the return is required to be filed.
Notice; Exception. The thirty (30) day notice specified in number 2 of this section may be reduced by the Superintendent by the number of days that an employee is unable to give notice by virtue of sickness, accident or other conditions beyond the control of the employee and may be further reduced by the number of days between the expected birth or adoption of the child and the date of an earlier birth or adoption of a child.
