Notice of Alleged Violation. The Tenant shall promptly notify the Landlord and furnish the Landlord with a copy of any and all summonses, citations, directives, letters or other communications concerning any violation or alleged violation of any environmental law, rule or regulation on, about or respecting the Premises, including (but not limited to) any violation or alleged violation of the Spill Act.

Notice of Alleged Violation. The Responsible Entity will notify the Supporting Entity in writing within seven (7) days of receiving written notice of an Alleged Violation from the Compliance Enforcement Authority as set forth in Section 5.1 of the WECC Compliance Monitoring and Enforcement Program. In the event that there is question or a dispute as to who the Non-Complying Party is, then the alleged Non-Complying Party shall immediately notify the other Party in writing and detail its support for why it should not be deemed the Non-Complying Party. Upon ten (10) days review by the other Party, that Party shall notify the alleged Non-Complying Party as to whether it agrees with the alleged Non-Complying Party’s assessment and both Parties shall mutually decide how to remedy and respond to the Alleged Violation within the time frame set forth in Section 5.1.
Notice of Alleged Violation. Upon its determination that Samsonite has violated the provisions of section 2 of this Agreement for a Plan Year, PBGC shall serve upon Samsonite a written notice specifying the nature and extent of that alleged violation. Any matters that may otherwise constitute Environmental Defects, but of which Seller has not been specifically notified by Buyer in accordance with the foregoing, together with any environmental matter that does not constitute an Environmental Defect, shall, be deemed to have been waived by Buyer for all purposes and constitute an assumed obligation of Buyer at Closing. Upon receipt of a timely Environmental Defect Notice, upon request by Seller, Buyer shall promptly deliver to Seller copies of all data, records, reports, opinions and other information in Buyer’s possession or control bearing upon or relating to the alleged Environmental Defect and its determination of the Environmental Defect Value, including, without limitation, site plans showing the location of sampling events, boring logs and other field notes describing the sampling methods utilized and the field conditions observed, chain of custody documentation and laboratory reports.
