Common use of Number Portability Clause in Contracts

Number Portability. 2.1 The Parties shall provide Number Portability (“NP”) in accordance with rules and regulations as from time to time prescribed by the FCC. The Parties will follow the LNP provisioning process recommended by the North American Numbering Council (NANC) and adopted by the FCC. The Parties shall provide LNP on a reciprocal basis. 2.2 If an “LNP Date Modifications / End User Not Ready” request is made outside normal business hours (if available) or is made within normal business hours and requires additional internal or outside work force, or the Porting Party requires a SOA release, the Requesting Party (i.e. the Porting Party or the New Service Provider) will be assessed an “Expedited Order Charge” as found in the Pricing Attachment of this Agreement. 2.3 By signing this Agreement, Parties agree that neither will request LNP of a customer without valid authority to do so. In the event that a customer claims that such authority doesn’t exist and the porting Party cannot produce its authority for doing so, service will be re-established on the original Party and the “Service Restoration” fee will be billed to and paid by the Party that requested the port without proper authority.
